I am furious!! (long... sorry)
Ok, now I'm not sure the President of our company was talking about me, but I am pretty sure he was. I overheard him talking to his assistant, talking about someone going on maternity in November (me). He was telling her to call HR to find out about leave or something, then to talk to "this person" about something that I couldn't hear... probably plans after maternity. But then I heard him get nasty about it like "I don't give a **** that she's pregnant"... "She's dead weight". Now he BETTER not be talking about me!!! I'm not busy every second of the day, but I get my work done... and then some. He has no idea what I do around here because he is NEVER in!! So I'm sure I'll find out at some point today if he was talking about me or not if his assistant sits down to talk to me.
Now I have no intention of coming back here, but would they consider that a resignation NOW? because I don't want to get cheated out of my maternity leave. I don't mind getting fired... in fact I may have a nice lawsuit if that happens... but I wouldn't mind unemployment.
I am just boiling right now because this guy is the biggest d*ck you could ever meet. He puts everyone down and has no heart whatsoever. And he doesn't like me for some reason.
UGH 11 more days of work. I cannot wait!!!!

If they know that you don't plan to return AND this guy is that much of a schmuck, then they would most likely consider that a resignation and try to avoid giving you your maternity leave.
Unless you have great maternity leave, let them fire you. It might be better for you in the end since you don't plan to return anyway. And you're right, you may have a nice lawsuit on your hands.

Hmmm... assistant did talk to me, and I asked her if I was the dead weight, and she says he wasn't talking about me. But I don't believe her. Yes... I'm paranoid.

I'd be pizzed and curious. I wouldn't be able to contain myself; I'd approach him (or his assistant) and say matter of factly (but in a calm and "friendly" tone) that you overheard them discussing a certain pregnant person who was due in November. Rather than waiting to find out if it was you (which would make sense), you thought you'd take the initiative to find out if it was and if so, what he wanted. If it was you he was talking about, I would also be sure to mention the fact that it is inappropriate and rude for him to be making such comments about you to others in the office, especially when others can overhear.

I wouldn't tell them anything about your plans to not come back, especially given the way your boss is behaving.
Tell them you are planning to come back at such and such time. Then sit back, and see what happens. If they do fire you, I would contact an attorney. You have a very good case, especially if there have been no discussions about issues with your job performance previously.
Leave is horrible in this country! This kind of stuff makes me mad--lots of politicians talk about "family values", but I don't see many policies in the workplace that really support family.

I agree. I would do and say nothing. I would just put in my 11 days and let them think I am coming back because I wouldn't want to screw myself out of any time off I am entitled to.

If the guy is as much of a d*ck as you say - do NOT tell them you're not coming back b/c he will do everything in his power to not give you maternity leave.
As for unemployment - it's not that simple - to qualify in New York you MUST be ready, willing and able to work. Translation: no unemployment for intended maternity leave b/c you're not "willing" to work - otherwise you would be at your old job!

Just get through the next two weeks, then take your maternity leave and quit after. Don't let them know your plans! Especially after what he said!

Def do not let them know your plans. There is a law in NYS that says that any employer can fire and employee without giving a reason. He can just state that he fired you because he felt you weren't getting your work done and leave it at that. I would be ****** though!
