I was laid off today after returning to work
I returned back to work yesterday from being off 12 weeks of maternity leave. They basically told me I either take additional weeks off unpaid and my job will not be guaranteed when I return or I get laid off and collect unemployment. I feel like they did this to me cause I just came back. my position is still there....one of my co-workers took over for me while I was out. She never work in this postion before and I am the only one in this postion. And she barley knows 1/2 the things I do. They kept brinign up that I would probably like to stay home with the baby and all. and kept brinign up the baby. I belielve what they did was moraly wrong and possibly can have a good law suit against them. What do you all think? I was there for 10 1/2 years and no one else was laid off today.

I would contact a lawyer and talk to them see what they think. I would think that you have a good case. Sorry to here that you god laid off some companies just su*k!

FMLA guarantees that your job will be there when you return at equal pay and status so I'm not sure if they're allowed to do that legally. I would threaten them with legal action and if that doesn't scare them, then actually go to a lawyer.

It does seem like its in violation of the Family Leave Act. If there was no issue regarding your job performance before you left...you are guaranteed yours (or an equal) position when you return.
Sorry this happened...i would seek some legal counsel.

 so sorry this happened to you. I'm sure you don't have a lawsuit. my friend was on maternity leave when citigroup laid her off. it's just they way things are now

Definitely contact an attorney-they are violating Americans with Disabilities (pregnancy is considered a disability) and FMLA.

I agree. It sounds like "wrongful termination". What was the exact reason for laying you off. Did they say they were "downsizing"? Seems a little shady and it can't hurt to contact an atty.
