is anyone here familiar with NYS labor laws?
i went for a job interview and they told me the work week was 42.5 hours (40 hours with lunches). i thought a work week was 40 hours and then 37.5 with lunches. is this legal? TIA!

as long as you are getting your required breaks, your work hours can definitely exceed 40

From the DOL website:
There are no restrictions on the number of work hours per day, except for children under 18. Likewise, there are no restrictions on how early in the morning, or how late in the evening, an adult employee may work. In some industries and occupations, an employee must receive 24 hours of rest in each calendar week, for example, work in a factory, mercantile establishment, hotel, and restaurant (except resort/seasonal hotels and small, rural restaurants), as well as elevator operator, watchman, janitor or superintendent.

That's definitely legal. My cousin's a surgeon and works 24 hour shifts.
My DH's office is open from 8-5:30 every day, so they all work those hours. My office is 8:30-5.

At my first job we had to wrok 40 hours a week- not including lunch
at my last 2 jobs- the 40 included lunch
every place is different

thats definitely legal. i had a 42.5 hour work week at my old job, it was 8:30am-5pm everyday with 45 min lunches.

The 40 hour work week has to do with an employee's right to overtime. Unless your position is exempt from the Fair Labor Standards Act, you must be paid overtime if you work more than 40 hours per week. Generally, lunch is not compensated as work time as long as you are not required to perform any duties while eating.

That's absolutely legal.
I normally work 50-60+ hours a week on a good week!
ETA -- but what other people posted about OT, etc. is all true!
