Lawyers - what does this mean to us working moms, if anything?
In my search to answer CathyB's question about the legality of using your sick time to care for you child I came across a NYS bill that was approved in June of 2007 and to be effective July 1, 2008 (figures I'm due to give birth in June!!).
Anyway if I'm reading it correctly (I am NOT a lawyer) it seems they are extending disability benefits for the full 12 weeks you are allowed to take for FMLA to care for your newborn, sick family member, etc.
Does this mean that anyone eligible for FMLA will now receive disability for the full 12 weeks rather than just 6 weeks? That's awesome if it's true.
Please can some lawyer mom help me understand all this!!!

It looks to me that those who take FMLA leave will get 12 weeks paid instead of the measley 6 weeks. That would be so much better. They also need to give more than 170 per week for 12 weeks. But extending the paid time sounds good to me.

I am not a lawyer, but I remember reading that Eliot Spitzer was either pushing through or approving this legislation last summer. It is great--6 weeks is just too darn short.

I called my leav of absence coordinator at work and asked about it. She didn't know anything about it, but said she'd look into it and give me an answer. It stunk for DS and I, but if it's true, at least I'll be able to take the time to deal for 2 at home whenever we have #2.
ETA I was actually glad I wound up with a c-section cause it allowed me 2 more weeks paid at home! I should never have to be happy to be cut open!

I would be shocked! Esp....since I only got paid for 8 weeks and then got nothing until I went back at my 12 th week. But if it was passed last summer...I wouldnt have a clue!

I read through it quickly, but based on my reading, IF your employer is governed by FMLA you are entitled to have that leave paid effective July 1, 2008.

Paulette, it's not effective until this upcoming July (2008), so you wouldn't have known anything about it last year.
I'm hoping it's true and I can be grandfathered in since I'm due early June!!

I don't know about grandfathered in, BUT I would say that if you deliver in June, the two week waiting period for benefits to start would apply (not the one week in the new bill), and that might carry you into July and you would get the remainder (ie: 10 weeks for a total of 12).

FMLA is national and entitles us to 12 weeks unpaid. Disability is NYS and gives 6 or 8 weeks depending on delivery. This new bill, effective July 2008, IF i'm reading it correctly extends NYS disability for the full 12 weeks rather than just 6 or 8 weeks.
Disability is only $170 a week, but it's better than the big fat zero we currently get after 6 or 8 weeks.

You are correct. FMLA however is unpaid, and disability is $170 per week in NY. The OP was asking about a new NYS law that creates paid family leave time.

I'm reading it the same way.
Keep in mind that state disability/workers comp may pay less than your current salary.

we that's good news then. I know disability is only $170 a week (which is less than my current compensation) but its better than nothing and a small step in the right direction.
