Legal opinions
Smething spiked my curiosity on this one. My parents are divorced. My paternal grandmother is still alive. My father has never remarried. I have a very strained relationship with my father, I have one brother that lives on the other side of the US. My father has 2 living brothers also. If something were to happen to my father, and tags were left up to the next of kin, who would that be?? If my grandmother were to pass would it be forced upon me since we live in the same state or would it go to my brother? my uncles?? just curious.

Legal opinions
I am not an estate lawyer, but I believe that without a will in NY, the estate would be split between your father and his siblings, and that if any of them are deceased at the time your grandmother dies, that child's share will be passed to their children (the grandchildren). HTH.

Survivors are generally the decedent's own children, so it would not be you because you reside in the same state.

Damn iPad and quick typing. Sorry I meant and things were left up to next of kin, who would that be. I am speaking more in terms of medical decisions. There would be no estate and I am sure if there is any money he has a will giving it all to his girlfriend ( my moms former BFF) and her grand kids .

Damn iPad and quick typing. Sorry I meant and things were left up to next of kin, who would that be. I am speaking more in terms of medical decisions. There would be no estate and I am sure if there is any money he has a will giving it all to his girlfriend ( my moms former BFF) and her grand kids .
If there are medical decisions like relative is sick and on machines etc then it will depend on a healthcare proxy and living will if there is one.
Next of kin is usually meant a spouse and then kids if the kids are adults.
