I have a great person I can recommend.
The one thing to keep in mind is the criteria for a med mal case.
Did the (medical person) deviate from the standard of care?
If the standard of care for an infant is what the doctor did (before she went to the hospital) you have no case. If the doctor deviated from that standard then you may.
This is more informative for you (and everyone). Just wanted you to know what the attorneys look at when deciding if a case is even worth taking on.
I am NOT an attorney but have been involved in a LOT of med mal cases at the law firm I work at. My information is NOT gospel. And I am NOT telling you "Don't call".
Just keep this in mind if you decide to call an attorney.

You need a deviation from the normal standard of care plus a permanent injury. Mere hospitalization, is in general not enough. I would still go for a free consult.

Ex- left a sponge in a patient during surgery is not a permanent injury. The patient undergoes another surgery to get it out. No permanent injury.

Yeah I think we want to at least meet with someone. She's still a baby so we don't know the permanency just yet but I came in to the hospital with a baby who did not have brain damage and we will be leaving with a baby who has brain damage.

No, it's definitely malpractice. I hate those cases.
To the OP, I'm a med mal attorney also but I defend. If you want a referral for a Long Island based attorney, PM me and I can give you some names. There are a lot out there. You need to find a good fit for your type of case.

With a great deal of respect I say this.
I also encourage you to get your case evaluated and see if there is a case.
Based on what you wrote. She went in with distress. They immediately took action and started treating her. Then while she was being treated all heck broke loose. Did what they do (or lack of) cause the brain injury, or was it just something that happened based on her condition.
So the main question is this: a. Did your Ped deviate from the standard of care by giving you the Neb and albuterol. Was that standard? Should they have "caught" something else?
b. Did the hospital deviate from the standard? Did they miss something? Did they not treat your little one correctly? Was giving her oxygen and treatments not the right call?
Once again This is ONLY for your information and to have an idea of what to expect when speaking to an attorney.
I pray for you every day and hope your sweet girl gets stronger every day.
