My fellow HR people..come in.

Answer me this -

if you are verifying dates of employment - does it matter to you if you speak to HR or Payroll?

I want to see the answers before I elaborate on a convo I had with my boss about it...

I've been out of HR for a bit but I always went by hire and termination date. Through HR not payroll.

It doesn't matter to me who answers the questions.

Payroll is supposed to verify employment dates but I will confirm too - provided they send a written request for the former employee, of course.

i guess it depends on what company you're calling. larger ones seem to have a designated hotline for things like that. smaller ones i'd go through HR as they typically have access to the employment files

Ok, I wanted to give more info now that I have a few responses..

The other day my boss and I were discussing a potential new hire’s references. I happened to confirm his dates of employment with the payroll administrator. It was a small company. Our process here is to confirm dates and speak with a supervisor if possible, to get a sense of what kind of worker they were. Sometimes as I am sure you all know, depending on the company, if you ask for HR to verify employment, especially if it’s a small company, you get the payroll person. And then there are occasions where I speak to HR and they provide me with the dates. It all depends.

So my boss says to me, “I have worked in HR for 30+ years and I never confirmed dates with payroll always HR”. So I explained that I always ASK for HR, but depending on what kind of company they are, sometimes verification of dates comes from the payroll person. And then she said, she never heard of that before. I was like, HUH???

She may have worked in HR for 30 years but my company has been around longer than 30 years & our policy is it's payroll's responsibility.

I only do it to help speed things along. Also our policy (as are most companies) is we don't give references, only confirm dates of employment.

By law though they are only REQUIRED to verify dates, nothing else. And from the employee's point of view, they shouldn't. A negative review is against the law. I can't get into details but we were contacted by DOL, HR/payroll or anyone from a previous company can not review conduct on any level. dates of employment are the only thing allowed.

Is that true? I don't believe a negative review is against the law. It does open the company up to a lawsuit (slander, etc) so it is foolish to do it. If the company asks for more info, when we say that we will only confirm dates of employment, that's usually a sign there are no rave reviews in the file

it is. DOL sent us their statment of law. its not clear on the site but they sent us a letter that made it VERY clear. I actually just pulled it. this was the exact statement

"It is acceptable for employers to provide neutral refrences, giving dates of employment and job title only"

the person we spoke with was Takeesha Washington (CHAR)
