name issues - need some advice
We are trying to buy a house and the morgage broker put all the paperwork in my maiden name but the lawyers drew up all their paperwork in my married name. I have not changed my name with SS or DMV. If I just show everyone my marriage certificate would that suffice to show I am the same person?
But here is another problem: My marriage certificate is packed up somewhere since we are in transition and silly DH just threw everything in boxes without labeling or putting aside the important stuff one day when I wasn't there. Would I be able to go to the town hall we got our original from and get a duplicate ASAP?

I would think that the lawyers would have to change it to match the mortgage, no? The mortgage should reflect what is on your SS card.
You should be able to go to the town hall though, but it takes a few weeks to get a duplicate.....

Your legal name is whatever is on your SS card. If you haven't changed your name, I'd make sure all of the documents used your maiden name. I think it takes a few weeks to get a duplicate marriage certificate.

yup i agree. techincally your legal name is still your maiden name cause you haven't changed it with DMV or SS. all paperwork should reflect your SS card at the very least...i would have them change it to the maiden name/

Call Town Hall and you should be able to get a duplicate if you go in person and pay for it.

You need to go with what is on your SS card. If you didn't change your name yet, you are still legally your maiden name. The contracts should match your mortgage paperwork as that is the correct one!

I think it needs to match. When we closed, I had a power of attorney for my husband since he couldn't be there. The POA said his first and last name but the papers included his middle initial. At the last minute, we had to have a new POA drawn up(luckily, we could get in touch with DH) otherwise we weren't able to close!!!

thanks everyone!! I was going to do it, but I guess this is the ultimate motivator (a year later, LOL)... the mortgage broker says they have to see a drvier's license, so I guess I can get a temporary one form DMV. DH is sure he knows where the marriage certificate is so I guess we'll be searching for that this weekend! ugh, what a pain!
