Need a lawyer pronto!! Updated in first post.
Please recommend your lawyer!! I need someone fast!! The sellers want the signed contract back by Thursday and my lawyer can't do it by then.

ETA: So it turns out that our lawyer can do it. Thanks for all of your recs!
We are supposed to sign the contract tomorrow, BUT they put some weird provision in that all debts have to be paid by closing. The only debt we have is DH's school loan for his MBA and there is no way we are going to pay it by then. Are they nuts?? Has anyone ever heard of this? My lawyer crossed it out, but i hope it doesnt cause a problem.

that was in our contract too - we crossed it out - our student loans are at way less interest than the mortgage, im not paying those off any time soon anyway

they cannot state that debt must be paid. If you are approved for a mortage then its the mortage companies responsibility to check debts NOT THE LAWYERS!!
I'm sure your lawyer will help you along with that provision.

That's the oddest thing I've ever heard of. Why are your student loans their business? You should say, "fine, we'll pay off DH's MBA but then we'll only have $5 to put down on the house"!

Seriously - who the f do they think they are?!? AND we are being super generous with a 90 day closing period. I bet you anything they are going to extend it an additional 30 days after that. I just have a feeling
They are buying a dump in Woodbury and it needs MAJOR work. We told them we could be extra flexible since we have nothing to sell.

That is totally insane, what in the word does it matter to them what you debts are as long as it doesn't prevent you from getting the mortgage. Thats none of their business! I swear there are some real crazy people out there

i've been doing this a while now and i've bought and sold a few houses of my own...NEVER have i seen that thrown into my contracts! or NEVER did my attorney let that happen!

If they extend the closing date and you already locked on the rate and you have to pay another lock fee, you need to have that in your contract. There needs to be something else in the contract stipulating something about the rate as well. If your rate goes up as the result of them not being able to close then there has to be a contingency.
