Neighbor/fence rant....
Okay, I need to vent here. We got our new fence in March. Everything is fine it is beautiful. We did everything legal. We told them to be careful there are underground sprinklers on both sides. Low and behold, my neighbor calls SCREAMING mad yesterday that he tried to put on his sprinkler for the season yesterday, why he waited till mid June is beyond me, mine have been on since late April, early May. he "claims" the fence people cut the hose on his inground sprinkler. Meanwhile the hose should be underground and not above ground. I saw it, and it is possible and it is also possible it could hve been cut from his lawn people or the weather during the winter since it was not underground, or his kids when they play . Okay, so I call the fence compnay and they tell me to have him call he can go thru there insurance company if he can prove it. The reason we got the fence is becuase his kids are animals- they play football on my lawn even though we have asked them nicely not to, they have parites all summer long and are loud and have been all over my lawn, etc. So what is my obligation, except to tell them to call the fence compnay right??????

was the hose near your new fence? Can he prove it was your fence company?
He's going to have to go after the fence company. I'm not a lawyer, this is just an opinion.

They won't be able to prove the fence people cut the hose. I would say since it could be any of the above reasons that you should be a good neighbor and simply tell them to get a written estimate to replace the hose or go to ACE Hardware; they carry the hoses and split the cost to have it replaced. It will be more trouble (for you and him) then its worth to go through the lengthy detective process of who did it.

sounds fishy... why would he start watering his lawn now?? does his lawn look all yellow and dried out? if not, I would ask him how his lawn is green without being watered for the last 2 months

I agree. I think it would be worth the small amount it would take to fix the hose and have the guy out of your hair than have him simmer about it and retaliate in some way later.

I would normally say this, but they way she describes her neighbor-it sounds like he would continually find something wrong. Best to have the fence company take care of it.

UPDATE***The fence company is going over to look at it tomorrow. *** Normally I would, but why should I have to split the cost when I did not do the damage.... The fence company told me if it was broken he should have noticed this months ago. How much can a hose cost .... gets me angry.... Also, these people attempted to use my BBQ when I went away once- the BBQ went into safety mode, and they have stolen veggies out of my garden! I do not need this now, my DH is having a hard time at work- he is a NYC teacher and the kids are crazy- I had posted about this a week ago. Neighbor says he did not put on sprinklers becuase there was a lot of rain.

does he realize you can sue him for trespassing on your property!!!!!!!!!! what an a$$!

I would file a complaint with the precinct the next time he does anything. I would also invest in one of those security cameras as well so you have proof.. So sorry this is happening!

Now that you added all the other issues you have with this neighbor, I take my suggestion back. Get a security camera and catch them in the act and press charges.
Maybe they should just work with the fencing company. However, I’m not sure what the fencing company can do at this point. The fencing company can walk away and say I had nothing to do with it and you're left with an angry neighbor that may take revenge. Is it really worth all this?
See what the fencing company has to say. At least they are taking a step to come out and look at it.
Your neighbor has the right to turn on his sprinkler whenever he wants and expects it to work.

I gave them the name and the person to talk to at the fence company .... they told me they cannot believe he is complaining now. Anyway... they told me he can fight it out with there insurance company, if he can prove it. I just assume go with them working it out. I doubt he is going to be able to prove it, what is to say it was not the lawn company he uses? Also, shouldn't hose for an inground sprinkler be underground and not floating on top of the dirt, mine is underground, and my dad and the old neighbor that used to live there had put in the sprinkler sytem together! I own the hose I grew up in... both my parents passed. When they were installing it I was home and they did not go on his side once.... but I do not want to have a confrontation with them. becuase of these people i have not put in a veggie garden in a few years and do not tell them when we are going away. Should I count the numerous times they were on my lawn and it was all walked on, the countless screaming contests they have had, parties to all hours of the night.... I just cannot believe after 3 and a half months he is saying this now. How much can a coupling and some hose cost? Geez- some much for good fences make good neighbors!

I have an idea....you should get a camera installed and if they ever bring up something, you could always say well remember that time you were in my yard blah, blah, blah.
And they'll say you can't prove it.
And you could say yes I can I have it on tape -- I should stop at times I could be bad

Let the fence company handle it. If he has no proof, he won't be reimbursed for the cost of the hose and presumably he'll drop it. Whose property was the hose on? If it's on his property, I assume the fence people wouldn't be on his property and wouldn't have cut the hose. It sounds fishy.

I agree with everyone else - let the fence company handle it. That's why they have insurance. You have no legal obligation because your contractor carries his own insurance.
The BBQ thing would infuriate me. I wouldn't give him one cent towards it because of that. Also if you suspect he or his kids come in your yard now that the fence is up - I'd definitely install cameras too.

I just thought about this...I recently had a fence installed and I watched them work. They do not use (or at least my installer didn't) any power equipment. They used a hole digger to dig the holes. I too have a sprinkler system and know what the hose looks like. It's pretty thick and would take some sort of powered machine to cut it, like a mower. I doubt the fence people were the cause.

I was home also when they installed the fence, and they did the exact thing you had written. I think it was from being above ground when it should not have been ( the hose) or there lawn people did it when they did a spring clean up.
