Neighbor trapping small animals??? Help!
My neighbor just informed me that she has been seeing a trap that another neighbor has set up by his house.
Well one day she saw an opposum in there and she was very upset, but when she went back it was not in the trap, so she figured he hopefully let it loose.
Well yesterday she sees a squirrel trapped in there and feels badly, but doesn't know if he is going to let it out. Today...she sees the squirrel DEAD in the trap.
She has called the police both times and no help. She has called the Humane Society and they have been no help. She is telling me this for the first time today, and she wants to write a letter threatening the homeowner about the use of the trap. She doesn't know what else to do!
Help! What are the laws? Is this guy breaking the law? Who can we call? He can't go trapping and killing small animals, can he???
She (and now I) are very upset. She also thought about stealing the trap but is afraid she will get caught.

The neighbor is not breaking the law.
If said neighbor hired a pest control company, they would set up those same traps and kill everything they caught.
eta- the traps may be placed there by profession pest control companies. And in NY, at least on LI- it is illegal to transport a live racoon, not sure about squirrels or opossums. Killing them is required by law.
Does she know that these traps are not placed by a professional company?

she does not know. She does know she sees the trap out there everyday and that is is always ready to spring closed.
I just called ASPCA and Humane Society. ASPCA rep seemed to say that if the animals are dying in there, that is not allowed. And that it is against the law to trap raccoons or other certain types of wildlife due to rabies risk. She didn't know exact laws.
My neighbor is calling back ASPCA now to give full details and hopefully they will get to the bottom of this, or at least educate her to know the law if the guy is breaking it or not.
Anyone else have any thoughts? I have tried to google and can't find too much.

that is such a terrible thing your neighbor is doing. there's a special spot you know where for people like that

She is not sure how to set it off and she would have to go onto his property. She was going to steal the cage, but afraid of getting caught. Hopefully ASPCA will come soon, or the police went there tonight (IF they have any right to do anything, or even care).
I don't love squirrels BUT don't want them to get hurt, esp when living their life like any other creature OUTSIDE one's home. I don't think ANY creature should get caught in there and be left to die.
My neighbor just told me this man has had the trap out for years! And she never saw anything in it till now b/c the bushes are gone since winter is here....she is very upset at seeing what she saw, and I am upset just hearing about it.

A property owner has the right to set traps, however, it is against the law and inhumane to leave the animal in the trap to die. A property owner may also set poison, but cannot do so if the public has access to the property. - If the location is in NYC the ASPCA investigates. Suffolk County is SC SPCA...Nassau County is NC SPCA

Thanks for that info.
This guy left a squirrel to die, god only know what else is dying in there due to the extreme cold and being trapped.
Nassau ASPCA is supposedly going to check it out.

That is terrible! Several years back my parents had a huge squirrel problem. They had about a dozen in the yard at a time. We borrowed a trap from a friend and would catch a squirrel and within a day we brought it to a wooded area. Why must he torture them? Its really not that difficult to see them free away from his home.

That is terrible! Several years back my parents had a huge squirrel problem. They had about a dozen in the yard at a time. We borrowed a trap from a friend and would catch a squirrel and within a day we brought it to a wooded area. Why must he torture them? Its really not that difficult to see them free away from his home.
I don't know what his intentions are, but he definitely forgot to check the trap and this one died. So whether this happens often or not, he needs to be more responsible.
We live not too far from a wooded area. It is possible he is bringing them there when he checks the trap, but I have a feeling he is not doing this. Hopefully Nassau ASPCA can get to the bottom of it. I really hope they come and fast.
We have a LOT of squirrels here too. They dig up my grass. But to me, I just accept it. They live here too and that is what they will do...there are so many by me that even if you relocate a few, it won't really help much.

Call NC SPCA again and tell them you will go to the media..see how fast they will then get over. They are useless, no comparison to SC SPCA which is great! Nassau County animals have no protection because NC SPCA is incompetent.

I remember when Suozzi first came into office he was planning to reduce the finding for this to make up for the deficit left behind by Gulotta. I hate that there is no protection in Nassau. I have had more than one issue with them....

yes - we saw this on animal cops NYC once - some NUT set up a trap to catch raccoons and just let them sit in there, for god knows how long, to starve to death - the raccoons tried, you could see, so hard to get out and died in that terrible state of panic - it broke my heart and it was disgusting. someone called the ASPCA and they actually charged the lady who did it!! thank god - but what happened to the animals - it was just awful.

Call the ASPCA on Monday...212-876-7700, Ext. 4450, get the statute number. If you see the animals in trap call police and if they say there is nothing they can do you can say according to statute so and so this is a crime.

OH I will do this, thanks. Will NSPCA be able to give me statue #? The dead squirrel was still in the crate as of yesterday.
