new condo owner-question/advice...long sorry

we bought our condo from someone who flipped it after the original owner died. there is a hookup for the washer dryer in the unit and the original owner had one. The RE listing stated 'washer/dryer capabilities'. We just figured he did not want to purchase it since he did a ton of other work but no big deal we were going to purchase what we wanted upon moving in. Upon calling the mngmt company they said we cant have once since we are on the 2nd floor-in the bylaws it does not state this and she said it was a 'new rule'. I did not say anything at that time because i knew i would have to put up a fight for this one.

I feel as though this is very misleading and in the bylaws it says it is subject to board approval-can we go forth and request for this to be brough to the board and ask for an explanation?

any advice is appreciated

When you closed you should have received a copy of the by laws from the management company. Is that new rule in there? If not, I would fight it and fight hard. All by-law amendments should be dated (they are legal documents) so I would compare the dates.

I would also have a serious issue with the RE agent, but it's quite possible it was a timing issue and the rules changed between the date of the listing and the date of your closing.

Also - what happens if you just buy a new washer and dryer? Since the hookups are in your unit + the RE listing, it would only be logical for you guys to purchase a new unit. How would the management company even know, unless a neighbor complained?

yes we received a copy of the bylaws but it does not say this in there only that additions of washer and dryer is subject to board approval. We thought of just getting the washer/dryer but someone on the board lives under us and he will probably make a big stink.

Yikes, that is tough! Sorry about that!

Maybe someone else has some good sound-proofing advice. We lived in a condo 8+ years and I loved it, but the neighbor issue can definitely stink sometimes!

you can request all the minutes from condo board meetings

see when this went into effect- and try to argue that it should be allowed


also some negotion points - have a tray under washer and dryer

also have a water sensor that automatically turns water off if there is any kind of leak

washer on the 2nd floor is done everywhere - show them safety precations
