So it seems that in Cali the ruling in the case against Newsom and his reign of terror is in! The Judge issued a permanent injunction to stop the Governor from issuing any more of his unconstitutional executive orders! Let’s hope the same happens in NY!!!

Ugh I’m afraid what will happen in New York if our limitations are lifted.
Unfortunately, that likely means my family will go back to isolating.

The judge found good cause to issue a permanent injunction restraining the governor from issuing further unconstitutional executive orders (under his emergency powers.) It does not mean their lockdown is over -unfortunately. He has been busy issuing several executive orders, all conflicting with existing laws. Governors have the ability to excercise emergency power regarding decision making (it has happened in Cali and it has happened in NY) like suspending some laws during the pandemic BUT to a certain extent and WITHOUT exceeding his legal powers. The judge ruled that he in fact did just that, and she placed a prohibition on any further acts that exceed his legal power.
As of right now there are cases still happening in NY and I hope we have the same results.

Is not necessarily so black and white but in his case having a trifecta Democratic state (governor, assembly, and senate) def does help move things along. This is why I’m so opposed to any trifecta state government. There needs to be a balance in power to make things somewhat fair/just, among other things.

Yeap, just like I said in the above comment, when the majority of the senate and assembly bodies are from the same political party it’s an easy check on their favor, like in the case of Newson, and our favorite guy Cuomo.

I first heard it from a Cali medical freedom activist group I follow, and also from different Cali senators. Then I followed up with several articles that talk more about it, like the one Nell posted.

The judge issued an injunction barring the governor from using his emergency powers for action that “amends, alters, or changes existing statutory law or makes new statutory law or legislative policy.”
In a nine-page decision, Heckman wrote that the California Emergency Services Act “does not permit the Governor to amend statutes or make new statutes.”
“The Governor does not have the power or authority to assume the Legislature’s role of creating legislative policy and enactments,” Heckman wrote.
Nobody disputes that there are actions that should be taken to keep people safe during an emergency.
“But that doesn’t mean that we put our Constitution and free society on hold by centralizing all power in the hands of one man.”

Exactly that. Plus emergency powers are suppose to be imminent and proximate, they’re not suppose to last endless time, or keep getting extended repeatedly. In a state of emergency, there needs to be phases that follow like recovery, and rebuild. So how is it that they’re still in the emergency phase after all these long months??

That's fine, but in the case of COVID restrictions, which are put in place to protect people and rooted in science, I don't see how or why political party would matter.
Are you saying one party believes in science and wants to make a good faith effort to protect people and the other does not?

Huh? When did I pin one specific party and not the other one?? I’m talking about complete power by any singular political party. I have my own reasons why I like/dislike Democratic ideals and why I like/dislike Republican ideals but in this post I’m referring to a specific politician (well add to that one Cuomo too) not to the party they belong too.
