Heidgen pleads to evidence tampering in DWI trial BY MICHAEL FRAZIER

Convicted murderer Martin Heidgen entered a plea -- without admitting guilt -- Monday to a charge of using a fellow inmate's saliva to contaminate evidence in his 2006 trial for killing two people in a wrong-way crash.
The plea to tampering with evidence allowed Heidgen, 26, of Valley Stream, to "plead guilty to the charges without admitting his ... guilt," according to a statement from the Nassau district attorney's office.
Heidgen is serving 18 years to life in prison for the July 2005 deaths of Katie Flynn, 7, and limousine driver Stanley Rabinowitz, 59, in a drunken crash on the Meadowbrook Parkway.
Nassau County Court Judge Steven Jaeger will sentence Heidgen March 3.
Jaeger promised to sentence Heidgen to no more than an additional 1 to 3 years in prison, said Heidgen's attorney, Oscar Holt of Mineola.
District Attorney Kathleen Rice's office objected to Jaeger's acceptance of the plea. "His actions and his utter disregard for the court and for justice are deplorable and deserve a separate, distinct sentence," Rice said.
Holt said, "After considering all the facts and circumstances, he thought it best to spare [the families] the trauma of having to relive the tragic events that resulted in his first arrests."
During the murder trial, a second DNA sample was ordered after a blood sample was thrown out because it had been mishandled by state police. Investigators said the second sample, from saliva in Heidgen's mouth, contained more DNA from a fellow inmate. After a new, uncontaminated sample was taken, a judge allowed the blood evidence back into the trial.
