Hi,
My DH got a speeding ticket on Sunrise Highway He was going 86 in a 55 MPH limit (believe me I've already screamed TONS at his carelessness) He went 31 over limit which means it doesn't show the fine (under 30 MPH would have been $195) and because he is 31 MPH over or above he has to go to court now. I cannot believe this!!
He has a totally clean driving record, first ticket in just under 10 years. He is a stand up professional and we are wondering if anyone has any advice for us as to how to handle this and what the cost may be for going 31 miles over limit? We know about the driver assessment fee already that we have to pay to motor vehicle which stinks too. Additonally, its 8 points on his liscence and he is already now in the middle of taking the 6-hour online course to get the reduction of 4 points:)
Thanks for any and all advice/insight from others who went through something similiar!

not a cop but.. kinda btdt myself. but it was a LOOOOOOOOOONG time ago
Check the ticket out.. somewhere on there usually is the ticket 'fees' or whatever saying how much it cost per mile over the speed limit. I had one with $5 for every mile on the ticket I got recently here in Texas.
When I got caught years ago going over 30miles I took probation and a driver's course to reduce the 'sting' if you will.

When he goes to court they will most likely plead it down. He may want to get a lawyer since they usually have a relationship with the DA

If he already has other violations on his license, it may pay to get a lawyer. 11 points or three speeding violations in an 18 month period is grounds for suspension of his license.

Well it says he automatically has to go to court since its over 30 mph over (31). A lawyer would prob end up costing more:)

If you have to appear in Hauppauge, there is virtually no plea deals anymore. I used to work with a former DA there and most often you have to pay the fee, etc. It is very different than it used to be years ago when you went in and talked to the DA and they reduced the charges. The cop will most likely be there, however, you can play the game where if you see the cop, when it's your turn before the Judge, you can ask for an adjournment saying you realized that you need to get a lawyer. Then, you can try again, hoping the cop doesn't show up the next time. If the officer doen't appear, I beleive, 2 times, you can have the ticked dismissed. It may be a long shot, but from what I was told (and this was about 4 years ago), it is your only chance to have things changed because they do not plea bargain anymore.

I would say give it a shot and go to court. Some districts are not offering plea deals anymore. But if the cop doesnt have notes or can't testify to the speeding ticket they may reduce it.
