NYC teachers..FMLA QUESTION..

I was told before I went out on maternity leave that Christmas break did NOT count in my time off. I just got an email from my secretary saying that I have to come back earlier if I don't want to lose coverage because it DOES count. What's the deal girls?

This is the debate. It use to be that a week off wouldnt count but it seems like know it is being counted.this is what i heard at the uft maternity workshop. Email
[email protected] she runs a maternity workshop and she will get back to you. Give her your name, phone #, file #, school you work at and a non doe email.

You can take an addition childcare (say a
Month if you want) my secretarty told me my return date was Dec 1 but i knew thew were wrong and should be nov1 well sure enough my secretary called and said it was nov1, but said i could take a childcare til dec1 (unpaid of course). I tok that and then decided to take the yr off.

Thanks so much! I just emailed her. I am keeping my fingers crossed..I know it's only a few days difference, but I want my few days if I am entitled to it!!!

It counts (I had DS Dec 22nd so I had the same problem) It counts as far ad the 6-8 weeks that you get off but you aren't using days in your bank for those days. But your 6-8 weeks off start the day you have your child

If school is closed for at least a week and you are not required to report to work, that week does NOT count towards your 12 weeks of FMLA leave. The FMLA regulations are very clear about this.

It counted for me. I had DS Dec 22nd (right before christmas break) Schools were off from the 24th- after new years and it counted as one of my weeks- same with the Feb break that we have that was within my 12 weeks. I had to report back exactly 12 weeks after I had DS...hmmm now im wondering if I just got screwed out of that time argh

I swear it really depends on your secretary! No one is really double checking those dates besides your secretary!I have coworkers who had week breaks count and others who it didnt count for

why does this NOT surprise me with the BOE! I feel like no one in the higher ups or the secretaries know what they are talking about! IT is so frustrating! Keep asking bec just like these responses you are going to get all different answers! Chat Icon Chat Icon Chat Icon Chat Icon

I worked in the BOE for 8 years and I am on my 4th year of childcare leave and I def DON'T miss it!

Thanks girls...It's interesting how many of us get different answers..of course I want the answer that says it DOESN'T count Chat Icon I put an email request into the pp contact and am waiting to see what she says. I am going to contact HR when my husband is home on Thursday so I can concentrate and not have the baby crying and dog barking in background!!!

DS was born on the first day of the FEb. break and those days counted towards my 8 weeks as did the April which was early that year.
OH yeah, so did any snow days in there!

Totally rip you off!!

Christmas week does not count from your CARS Bank. It does count from your maternity leave.

You have to return to work when your dc is 6 weeks for regular birth or 8 weeks for c-section.

FMLA allow you to take up to 12 weeks of unpaid time. Honestly, I think every school has their own set of rules. I always spoke to Grier Hansen. Good Luck & keep emailing & calling UFT.

It should NOT have counted. That violates the FMLA.
