ok, so somehow a 4 x 4 section of the ceiling in one of our bedrooms came crashing down yesterda
harming only a very nice wooden bookshelf she had in there (thank God...our 5 year old niece was about two steps from being underneath it )
they are coming today to assess the damage.
we live in a rent controlled apt and they tend to NOT like to do work in it b/c quite simply...they will never recoup the money as long as we are there so they are prone to sloppy slap dash type repairs.
does anyone have any experience with this? know any demands we can reasonably make?
are they responsible in ANY way for the destruction of our property and do they owe us a replacement?

I believe they are responsible for fixing the ceiling but your renters insurance would cover replacing the book case. At least that would be the case in my building.
I am so glad your niece was ok.

Do you have renters insurance?
Also, do you have a lease? If so, it should list it there.
My grandma lives in a huge rent stabilized apt. and I can tell you that they always sit on it and never make the repairs quickly and even when they do it's half-a$$ed. I've had to go up there myself and get on the super.

we don't have renters insurance
we DO have a lease...but I've never laid eyes on it LOL. the apt has been in dh's family for 30 years (it's in dh's name now)
I really just want to tell them to stop EFFING around. there is some structural damage that MUST be looked at. we are on the first floor....
but at the same time...they will use the cheapest labor, cheapest materials, and cheapest EVERYTHING...like putting a finger in the dike...until we leave (which will be when I take my last breath of air)
I mean, I get that it's a business and they are losing money on us...and I don't need to live in the "Oro" building for the price we pay, but I'd like to be relatively certain that the walls aren't going to cave in on us!

We are rent stabilized and the "repairs" thye do are a joke, after they make you wait around all day to show up.
We have actually had someone come in to do a repair that wasn't affiliated with the management company because frankly, we didn't want to deal with them, but we paid for it ourselves. You could try getting the $$ back for the bookshelf, but you might have to resort to sue them for it in small claims court if they are not responsive.

If this is the case, I would take photos of EVERYTHING, send them copies and a letter requesting exactly what you want done and send it certified mail. If you have a friend or family member who is an attorney, cc a copy to them as well.

Renter's insurance would cover the bookcase..unfortunately if you don't have it the landlord doesn't have to cover. The damage done to the ceiling they must cover though under the terms of your lease. I had a huge flood in an apartment a few years back and only the work to fix the leak got done. They refused to replace anything that got destroyed from it because I didn't have renter's insurance!
