paying for records?
My previous OBGYN wrote this obnoxious letter telling me he will not release my records to the new dr without paying 75 cents per page. What the heck is that? Hes charging me for pap smears from age 16. My new dr told me ask him for the newestr pap smear and send him a check for 75 cents! How obnoxious is that!!!!

I don't think he can do that because of HIPPA. They are actually your medical records. I have only heard of Dr's charging for medical records when requested by insurance companies.

75 cents in the maximum a doctor CAN and by law is allowed to charge to a patient for each page of their medical records...
It is a bit obnoxious but its legal

That is not allowed - he can charge you to copy the records for you BUT to send to another dr. he cannot charge!!

My doctor told me that they would charge me per page if they gave ME my records But they said they would fax them to my RE for free. Go figure. I dont get it.

Have your new doctor's office request the specific records they want/need if you don't want to pay the fee (they get away w/o the fee for "continuation of care"), otherwise if you request the records personally, they have the right to charge you. (I worked in medical records for a few years.)

I agree with this. I have a friend who was going to be charged this 75 cents per page fee when her doctor retired and the records were sent to the "recommended" new doctor's office. The fee was being charged by the NEW doctor!! She ended up finding somebody on her own and that doctor requested the records from the highway robber's office and it didn't cost her anything.

The files/documents are considered property of the doctor's office/medical facility/etc..
The sad part is that .75 is the maximum a healthcare facility/medical office can charge, yet almost every office just uses that number.
It wasn't uncommon for me to send out bills for $600-$700.

I totally disagree with my records being property of the DRS. I agree that if I want them for my own personal file maybe he would be justified. My DR sent a request for them. I am not a patient of his anymore and he should be releasing my records to another DR regardless of my payment for them. I also worked in a hospital (not in medical records but as a therapist on the psych unit). DRS have consistent acess to patient records with out patients paying for them to be released to these DRS. Imagine if that was a rule of thumb...a patient could be in a hospital bed and a DR would say no to their DR without a payment of 75 cents...thats BS!

I had a previous post in this thread that stated a doctor can request the records w/o being charged a fee for "continuation of care".
Regardless of whether they're free or not, they're still property of the original doctor/facility.
Yourself or anybody else given authorization, other than another medical office/facility for your "on-going care", can be charged.

also keep in mind.. a new physician doesnt need your pap reports when you were 16.. they really just need your current stuff or anything important thats happened that he would need to know...

Thats so true. My new DR told me to tell him I want the last pap record and write him a check for 75 cents

Your old Dr. is required to keep and store your records for at least 7 years regardles of whether you've switced Dr.'s. I also thought 75cents per page seemed excessive for copying charges, but in my old office they had so many records that they had to rent storage facilities and then every few years hire a shredding truck to discard outdated charts, plus medical records staff, etc. etc. -- it actually adds up tremendously! To get around paying for 10 years of useless info., just request in writing a copy of your records from say January 2005 to present.
And be glad you're not requesting medical records for a lawsuit -- its 75cents per page and then your attorney pays the doctor $200++ to write a one page "synopsis" of what the whole file contains.
