Unbelievable. Sounds like the store took it too far.

thats what all criminals say...it was a mistake....
yes, it was a $5 sandwich but maybe if she had walked out with a $10 roast beef or something else, then should turn their head also?

I'm sorry but that's a really harsh judgement. I've opened a snack in a store and forgotten to pay before. It could happen to anyone.
And the store saying they didn't know the child would taken away? BS! What did you think was going to happen after both parents got arrested? The kid was going to stay at the store and wait like the groceries? Please.

Re: Pregnant mom arrested for a sandwich
I don't get it. She saved the wrapper to be scaned, it seems they were still in the store when questioned by security. But they weren't allowed to pay for the item? I always assumed you couldn't be charged with shoplifting until you left the store.
Never mind....I see that they did leave the store.
Still think it was harsh for an Air Force Staff Sergent to be treated this way over $10.
WOW
A police officer escorted them back to the store — which banned them for a year, Leszczynski said — where they picked up their groceries and walked home just before midnight.
I would have demanded a refund. I wouldn't have given them a penny of my money!

Re: Pregnant mom arrested for a sandwich
Horrifying.. seriously. It's FIVE EFFING DOLLARS. They offered to pay.
Lecture them, ban them, make them pay.. but to call the police and arrest them for shoplifting over a sandwich? Seriously? The store likely has a lead loss of thousands a week and they arrest a pregnant woman and separate her from her toddler because of a sandwich? That's ridiculous.

Re: Pregnant mom arrested for a sandwich
I feel like there is more to the story than what's being presented.
Outside of the deli guy offering you a slice of cold cuts, I don't think people (kids included) should be eating in supermarkets.

thats what i am saying....
and ITA...dont eat in the supermarkets.
I worked in one for years as a kid and i remember throwing away wrappers for candy, cookies, cheese and milk that people had eaten and "said" they would pay for when leaving but somehow they ended up on the shelves....

Re: Pregnant mom arrested for a sandwich
I'm surprised they did this from a liability standpoint. The mom was visibly pregnant. What if spending the night in jail AFTER they offered to pay for the sandwich caused her to miscarry? I don't think I would want that on my hands. Sounds like the store manager was on a power trip to me.

Re: Pregnant mom arrested for a sandwich
I think there must be something more to this story. According to the news they had already paid for $50 in groceries. I think arresting them took it too far. Let them pay the $5. Ban them from the store. But to have them arrested for $5. I think everyone over reacted here.

But that's like saying pregnant women are above the law What was more visible was the 2yr child that was with them and considering they already spent $50 in the store and not ate the sandwich and ran the manager should have really considered their side of the story and just made them pay the forgotten sandwich to avoid what is now a potential lawsuit.

Why would the store (and the police, for that matter) be responsible for a miscarriage unless they were physically restraining her?

She broke the law. If you have a medical issue while in jail you can still get treatment.
I don't see any liability issues here.

Re: Pregnant mom arrested for a sandwich
OMG that is horrible and WAY too extreme
I have to tell you, this baby brain thing is NOT a myth. Just yesterday DH and I were at Dunkin Donuts and I ordered a latte, pumpkin muffin, and egg sandwich. I went and waited by the coffee area for my coffee. They gave me the egg sandwich there and the coffee and I said I was still waiting on my pumpkin muffin. The guy apologized and brought me one. It wasn't until we were in the car that I realized DH was holding the pumpkin muffin
What's worse is that he said I handed it to him and I did not remember. I felt so bad that we "stole" a muffin but it really was a mistake!
And I did it again later that day when i bought a bunch of stuff from duane reade. I didn't realize that I was still clutching a chapstick and thankfully i realized that and paid for it but to think I could be arrested for this?!!!

Re: Pregnant mom arrested for a sandwich
There have been ocassions when I've eaten a candy bar or drank a gatorade/OJ while in a store - sometimes I feel like I'm going to pass out and get the shakes and I need to eat or drink something to regulate my sugar. It doesn't happen very often at all, but it does. I always pay for the item when I check out. Yes those that leave empty wrappers around the store and don't pay for stuff ruin it for everyone else, but if you're paying for it, why is it not ok? FTR, I do try to carry something in my bag for this kind of situation, but sometimes I already ate it and didn't have time to replace it, or sometimes I just go in with my wallet and don't have my bag. Stuff happens. This couple had gotten lost, she was pregnant and hungry, I totally see why they got the sandwiches while shopping. She had the wrappers too and mistakenly didn't pay. Who knows if they didn't pay on purpose, but honestly for $5 total, the store definitely over reacted. Talk about giving them a bad impression of their new neighborhood.
Yes stealing is wrong. Of course! But in this instance, 30 week pregnant woman with a child and her husband, why not just ban them, make them pay, etc. To arrest them and take their child away? Too harsh IMO.

Ridiculous and the police should have stepped in here rather than arrest them. My kids are almost 3 anfd would be hysterical if a stranger took them. That breaks my heart.

Re: Pregnant mom arrested for a sandwich
What a mess. That was a mistake. To take the child away was unnecessary. Someone (maybe a police officer) should have tried to defuse this situation.

I think Safeway was WAY out of line in this situation.
I was reading some of the comments under the article- and someone had VERY goo point.
Lindsay Lohan stole a $2500 necklace and was treated better than this young family who "stole" a $2.50 sandwich.

Re: Pregnant mom arrested for a sandwich
This is nuts. I worked in a grocery store throughout high school and college and yes, people who were obviously stealing ate and left wrappers all over. But, there were also people who ate while shopping and paid for it at the check out and we didn't really think it was a big deal. Yes, on occasion there were people who honestly forgot to pay for an item or acted like they "forgot" but if they purchased a bunch of groceries and left out a $5 sandwich, we would have just asked them to pay for it, not arrest them.

Re: Pregnant mom arrested for a sandwich
One of my college jobs was as an undercover loss prevention officer for a major retailer.
We were in fact allowed to utilize discretion.
Most of the time we called the police, but every once in a while we didn't. Even if we did, we didn't always press charges.
Some situations just didn't justify an arrest being made. It sounds like this was one of them.
However, we might not know the whole story.
