Q about stopping work before giving birth...
I'm going to talk to my HR dept after my next doctor's appt but figured I'd ask on here if anyone else has been there, or knows...
If you decide to stop working before you actually give birth, can you/did you use your accumulated vacation days before your FMLA/disability time actually started?
I put in my FMLA and disability paperwork request effective Monday, July 6th (my due date is July 5th). Basically I start to lose vacation time as of this date if I don't take it (my vacation calendar runs from Sept-August and we have a "use it or lose it" policy). So if I do end up overdue, I was thinking it doesn't make sense to me to keep working if I am going to lose vacation days anyway, but I didn't know if disability/FMLA leave was based on when you give birth...

Depends on your company policy and boss. Has nothing to do with fmla.
My company wouldn't let me do it, but a lot of companies would.

You can use your vacation time along FMLA - since FMLA does not guarantee you payment.

With my company you can use your vacation or personal time then get your 12 weeks FMLA so if you have 2 weeks of vacation use it this week and next week then let's say you give birth July 6th your FMLA kicks in so a total of 14 weeks.

Exactly this for me too. I could take vacation time before (but not FMLA). I usually work til the end (literally) & maximize time with baby.

This. Some companies make you use accumulated PTO before using FMLA, some actually make you use PTO in conjunction with FMLA. You'll have to see what your company's policy is.

Really depends on your company. I could have started my FMLA before my due date long as my doctor signed off. I would have started using my sick time as soon as my first day of FMLA, regardless of when baby born. FMLA has nothing to do with baby being born.

And some wont let you use vacation days bc they want you to save them for when you come back (more like blackmail to make you come back even though you knew you weren't). That's when you use all your sick days

Definitely depends on the company. I work for a small firm so I do not get fmla. If I were to stop work early, I'd have to use my remaining vacation time and then anything else would be unpaid until short term disability kicked in after birth.
