Question about being pregnant and discrimination in the workplace?
Now that we are coming to the end of the year, I will be discussing the benefit and compensation package for 2008 with my employers. Since I will be out for a period of time in 2008 for maternity leave, are they allowed to lower benefits such as vacation time and compensation based soley on the fact that I will spend 12 weeks on maternity leave?

They can make you use your personal time off. Every company handles disability differently. Some companies have policies where you are required to take your sick time beforehand.
They can also pro-rate your commissions based on your time out.
eta. They cannot base your review or any increase in salary on your disability time.

Thank you. Can they decrease my vacation/personal time because of my leave? Say, instead of giving me 4 weeks, I am given 3 weeks because I would be out for 3 months? This is regardless of if I am made to use it during my leave.

Yes they can, based on how it is worded. I "earn" my sick days, a little bit each paycheck. Since I will be out for a certain period of time on unpaid leave, I will not be "earning" them, so my overall accrual for the year is much lower than it normally would be.
I am a teacher, so I am not sure if it is different from other industries.

I wanted to add that a lot of companies also have a policy where you do not accrue vacation time during the period you are out on leave.

Your pregancy and negotiations for compensation and vacation/sick time should have nothing to do with one another. You should be given what you would be given if you were not pregnant. Like someone else said, if your sick or vacation time is on an accrual system, you just wouldn't acrue any during the period you were out.
