Question about disability
My employer does not have it's employees pay into NY Disability., which really stinks. Lots of people are telling me I can collect anyway, they're wrong, right?

Your employer has disability, why wouldnt you be able to collect on it? He fills out a form yearly showing how many males and females he has and pays a premium based upon that... sounds fishy

I have no idea. It's a school district. We do not have "disability" taken out of our paychecks.

If your employer is not paying NYS Disability this is totally illegal. He can be fined greatly. You should look into it again as this is a major major offense.
You do not have this taken out of your paychcek like Social Security, the responsibility is solely the employer's.
That being said, whether or not he is paying for it, you have a right to collect it. I had an issue with this in the past.

I'm not sure, but I know teachers have different guidelines (like NYC teachers for one thing are not covered under Workers' Compensation). Maybe some of the other teachers on here can help.

How can NYC teachers not be under W/C??? That seems insane to me!

I don't remember the reasoning, but my dad was a NYC teacher for 30 years & that is the way it worked. I have to ask my sister - she is a teacher/administrator for Nassau Boces - she'll know for sure.

Does that mean he gets to sue the school district if something injures him while on the job?

That's exactly what happened to him - he was hurt by a bunch of kids one halloween while in the school yard. The problem was, though, the lawyer that the union provided him ended up going to jail for stealing client's money, etc & his case had lingered w/o proper work-up so by the time he found out that the lawyer went to jail, the case was very old & the Board of Education moved to have it dismissed due to lack of prosecution and the fact that depositions had never been taken and evidence not preserved, so even after we hired another lawyer, the case was dismissed. We found out that it is very hard to fight the NYC BOE!

I know! He was in his early 50's when it happened & lost time from work (plus had to use his sick time) and he ended up with partial hearing loss in one ear and something with his nose (not broken but I think it was a deviated septum)
The only reason he was out there at the time was because they had a meeting that morning with admin & security because they knew that every year the H.S. kids from nearby would try to "attack" the JHS kids where he worked with eggs, etc. They decided to have a full force out there to control it. Instead, nobody but my dad was out there & they tried to push through the fence in the yard & he held them back. Then they started throwing eggs, potatoes & rocks toward him. He got inside, but only after being pelted in the head and body a few times. Thank god he wasn't seriously hurt, but the screw-up with the lawyer really sucked.

NYC school teachers are covered under the union.
