Question about improving on an existing product
I recently bought a safety product for my house as part of my "baby proofing" and it is close to what I want, but doesn't exactly fit my needs. I've searched on the internet, and it seems that this product is the only one like it.
If I make something similar but improved to meet my needs, and market it, can they sue me? Can I apply for a patent for a product that's similar to an existing patented product?
Thanks!

Re: Question about improving on an existing product
I imagine the product you design should not resemble the original product. If you are on to something, you should talk to a patent atty. They would start out by conducting a search to make sure your product is not infringing another company's patents. It's definitely worth a shot!! Good luck!

Re: Question about improving on an existing product
Thanks. My lawyer doesn't handle patents but referred me to someone in the city. I'm calling tomorrow.
