Question about maternity leave - edited - look what I found on my intranet at work
Hi Girls, I understand that in NY you get 6 weeks for childbirth (8 weeks for c-section). I am trying to find out if this is the same here in North Carolina. Any idea where I can get his info ( I am sure I could ask HR but I have not told my job yet)
TIA
Steph
edited for spelling
I saw this wording on the company website:
Maternity Leave vs. Pregnancy Disability
Under TIAA’s Maternity Leave Policy, employees are eligible to take an unpaid leave of absence up to 4 months before the estimated delivery date. Barring medical complications, pregnancy disability generally begins two weeks prior to the estimated delivery date. After the child's birth, employees are expected to return to work on the first business day following three months leave (including the pregnancy disability period).
Looks like I get paid for 12 weeks (week 4-12 will get paid at 80%)
That is what I was hoping for
I also will have 4 weeks of vacation so I f I am reading that right, I will have 16 weeks off with my baby.....

Re: Question about maternity leave
I would call information and see if you can get a phone # for NC state disability. Let us know also, I am curious to what other states offer.

Re: Question about maternity leave
Maybe there is something listing in your employee manual...if you have one.

Yes, I looked in that and it just says how short term disability is paid out (ex. after 5 days of not working, weeks 1-3 are paid at 100%, weeks 4-12 are paid at 80%, etc)
It does not say anything about maternity leave. I guess I will have to do some more research
Thanks girls

Re: Question about maternity leave
I live in NC and under the FMLA law you get 12 weeks maternity. Whether or not you get paid for it is up to your company. I don't think it matters whether or not you've had a c-section. I had one with Caiden and will again with this one. With him I only took 6 weeks unpaid because I couldn't afford to be out longer than that. It was a SMALL company. With this baby I'm hoping to take the full 12 weeks but only 7 of those will be paid.

If I'm not mistaken, you don't need to be out for 5 days before being on STD when it comes to giving birth, because I had the same question. Also, I would assume (but you know what they say about that) that they pay out would be the same as stated in your manual. I believe that FMLA is a federal law (again, I don't know for sure, but think I heard this somewhere), so your job is protected for 12 weeks, but the pay-out is up to your company and insurance provider.
Sorry I know that's not much help. I tried looking up North Carolina labor laws, but couldn't find anything about disability.
ETS: If your company has STD benefits, then I would think you wuold use that as opposed to the pay that you would receive from the state (if NC offers anything, like NY does).

Geez, this is so confusing. I will have to ask HR, once I get the balls to tell them that I am pregnant. I am so nervous about that, I do not know why
Well I do know why, I have not been at my job very long, w I can not afford to lose my job, I am stressing!!!!!

I know! It is very confusing. At least know that your job is protected by FMLA, which is 12 weeks. So, you won't lose your job, but unfortunately, you may not get all of your pay. I know that for my company, as well as many other companies, the % that you receive is based on your time at the company. So if you were only there for a year, the pay out may not be as good as for someone who was there for 5 years.
Good Luck! I wouldn't worry about telling them. They really can't do anything...but I can understand why you are procrastinating

Just read the top. That's great news! TIAA is a big company so I am not surprised that they have a good policy.

They have AWESOME benefits.......they contribute 15% of your salary each year to a pension plan. The employee contributes nada. After 5 years, you are fully vested, that is a great perk

Re: Question about maternity leave - edited - look what I found on my intranet at work
It sounds very similar to the benefits that I have. I have a profit sharing plan, so the % that they contribute at the end of the year depends on how well they do that year, but it's always a very nice amount. We are fully vested after 5 years as well. Also, they pay for our insurance and 90% for our family members. It's really great when you can find a company that still has great benefits like ours. But, unfortunately, these companies are hard to come by now.

I agree that they are hard to come by. Another reason why I want to make sure I have this job after the baby is born

Stephanie, you just started a new job right? FMLA doesn't protect you (or your job) b/c by the time you take your leave, you wouldn't have been working there for at least 1 year. FMLA only protects employees who, at the time of the leave, have been working for the employer for at least 1 year and have worked 1250 hours.
However, it sounds like your company's employee handbook has a great maternity policy and should protect you. Does it mention anythng about who is eligible for coverage/paid leave?

It says that employees are eligible for STD immediately, there is no waiting period. I think I am good to go Thanks for the info

Re: Question about maternity leave - edited - look what I found on my intranet at work
I would call HR....often STD will not cover a pregnancy without a waiting time and the time off seems to be FLMA..it doesn't say anything about pay. I got STD. It does NOT cover the entire maternity leave. It only covers the "disability" portion which is 6 weeks post partum (not even longer for c/s) and medically necessary time before the baby. The company can give you unpaid time off. But STD will not pay that time off just because the company gives it to you.

I guess I will have to clarify this with HR when I tell my job about the baby. I am not going to worry about it right now. It is what it is right?
