Question for HR/benefits people
I just spoke to my HR person and wanted to know what kind of Short term Disability coverage we had (since I have to use it for martenity). He told me that the firm bases my STD coverage on my YEARS OF SERVICE with the company.
Is this normal??

usually employers are not responsible for paying you during your maternity leave...although many have adopted policies in which they do....(ex) making up the difference of what the state pays you...so that you actually earn your regualr salary.
the state usually pays you a portion of your salary for 6 wks if you have a vaginal birth or 8 wks if its a c-section.
although FMLA states that your employer must hold your position for 12 weeks...from teh date you leave to start your disablity...(not the date that the baby is born)
FMLA states nothing about paying you....only that they have to hold your job.

Some companies with paid maternity leave often base the rate on the years of service but there is no hard and fast rule about it. I am pretty sure pd maternity leave has nothing to do with short term disabily -- that is determined by the state.

If you are going to receive compensation over and above what's available through the STD policy, then yes, it can be based on length of service because they're not required to give any additional compensation at all.
however, this should be worded in a policy that all employees receive...
yes, my place does something like 1 year of service equals 1 month.

Yes - they can base your STD on years of service.
Maternity is Short Term Disability for the 6-8 weeks post partum.

Ours is based on service dates too. There is a baseline of 2 weeks, then for every year of service you get an extra week paid.
So, I have 8 years of service. I would get 10 weeks paid (so long as I was still medically disabled).
I think it's pretty standard. There should be a written policy somewhere.

We dont have a written policy, anywhere. Which is a major problem with this firm. They dont want to put anything in writing.
I did ask my HR person to put my STD and LTD and maternity info all in writing for me.
