question for lawyers or those familiar with medical law (not malpractice)
My best friend is a PA, she works for an alternative practice that treats end stage cancer patients with low does chemotherapy. The practice does not accept insurance and pays to opt out of medicare. Patients have to sign a consent form acknowledging that they cannot submit any bills to medicare for reimburstment bc the doctors opt out. My friend has worked under the doctor's npi since she started 2 years ago. She was recently hired to work in the er at LIJ per diem and had to apply for and obtain her own npi number. Now that she has her own she has to use that at the private practice as well. Because of this the office manager approached her today and said that she had to also opt out of medicare and sign something saying that she did. She didn't sign as she's concerned this will affect her position at LIJ bc they do accept medicare. She spoke to the private practices lawyer who told her it was not a problem but something seems off. The office manager who also happens to be the owner and head doctors wife was getting very defensive and demading when she wouldn't just sign without looking into it herself. She told her that if she didn't sign she legally could no longer work at the practice. So basically my question is does this seem right? Can she not work there without signing legally or are they saying that bc it's just easier for them and less chance of something happening with a patient submitting to medicare and them getting a fine? And if she does sign will it really not mess anything up with her other job? And if no one knows the answer since this is a little unique can someone recommend a lawyer that would be able to help her? Thanks so much!

I am almost certain that you can have multiple NPI numbers for different jobs.

I think so too. She could also write in language that says "limited to (name of private practice)". In any event, if she is employed by LIJ and not a private ER staffing group, I believe the hospital bills for her as the hospital, not for her as an individual.

Thanks so much for the responses, I passed along the info. I'd still like her to meet with her own lawyer before signing anything so if anyone can recommend someone I would really appreciate it.

she also can ask LIJ since they probably have people on staff who can answer this. Is she a member of the AAPA (PA association), they too can help guide her.
