Ok, Im reading posts on what you are doing after baby is born and u go back to work and Im worried about what was offered to me.

So before I state what, what are we entitled to and how much?

Time off, paid, disability. How does it work for you and your company?

TIA!

ETA: I work for a company but my checks from from my boss.
So, is she able to decide my term away?

Lets just say it was one way and then changed to less!

My company uses short term disability as maternity leave. For a vaginal birth its 6 weeks, plus 2 add'l given by the firm and then one week of our own sick/vacation days prior to our disability kicking in. For a c/s its 8 weeks, plus the add'l time. This is with full pay.

I believe FMLA allows for 12 weeks unpaid.

My company (nothing to do with my boss) is using short term disability also. 6 wks for vaginal, 8 wks for C-section.

I can apply for the FMLA to extend to 12 wks (included the 6 or 8 wks paid by my cie). If I don't have sick time, vacation time to cover after my 6 or 8 wks, the balance until 12 wks will be unpaid.

FMLA is independent from any company. It is a Federal coverage which guarantees you not to lose your job at your company up to 12 wks per calendar year. It is for you or a family member. Note: it does not guarantee that you will have the same job but you are guarantee to have one in your cie.

This is how mine works (2 weeks before birth and 10 weeks after - then I am taking another 2 weeks unpaid)

The 1st week is paid at 100% (considered PTO)

weeks 2-4 are paid at 100% through disability

Weeks 5-8 are paid at 80% through disability

Weeks 9-12 - are paid at 100% through my company directly (this is a new poilcy that began in 1/07)

Last 2 weeks are unpaid

I am getting off 14 weeks in total, 2 before, 12 after birth

My company gives 90 days at full pay starting the day the baby comes.

They consider it "New Parent Leave" and not part of the FMLA.

Just to add that yes, it is federal coverage, but companies with less than 50 employees are not required to grant FMLA and if you haven't worked at least 1250 hours in the past 12 months, you may not be eligible.

I am doing NYS short term disability as well. So, the standard 6 weeks for a vaginal birth and 8 for a c-section.

My company is also letting me use all of my saved vacation, personal and sick days, which adds up to 26 additional days at 100% pay.

Since I am the first person EVER to have a baby at my firm, we haven't quite figured out which comes first yet.

I am not eligible for FMLA as I work for a firm with only six employees.

I don't believe so. I really need to look into this. I believe that NYS short term is a % of your pay, but not the whole thing.

Some girls on here have said it is $170/week? I don't know if that is the same for everyone tho.

I work for a big insurance company and have been here for less than 5 years, thus I am entiled to the following:

1 week w/full pay before giving birth;
Maternity Leave via NYS Disability @ 66% of my salary for 6 weeks (8 if give birth via C-Section);
all the rest includes any vacation days, personal and sick which for me equals to about 30 days w/full pay.

You're exactly right...it depends how long you've been with the company.

I work for a huge company that has a set maternity leave. I get 13 weeks 100% pay and can then take all 5 weeks of my vacation and I can take 12 weeks FMLA.

Do you have an HR dept?

No, NYS Short Term Disability. I mean I think either the company pays into it, or you do out of your taxes (preggo brain! sorry) but that everyone is entitled to. And it isn't just for pregnancy either.

and NYS state allows you take up to 12 weeks off with your job being held. you just dont get paid for the rest of the weeks....

Thats funny I was just talking to my HR person at my job today about this.

My job offers short term disablity and that is it for 6 weeks. But I am not planning on returning to my job at all. Because I do not like it there and I will start looking for a new job a little while after the baby born.

Do any of you girls know if I am stll entitled to short term disability even if I am not coming back to my job? I am telling them before I go out that I am not returning.

FMLA, which is a federal law, allows you to take up to 12 weeks unpaid leave for the birth or adoption of a child. Some states have adopted more generous laws on maternity leave, but NY isn't one of those states. FMLA only applies to employers with 50 or more employees within a 75 mile radius.

I wouldn't tell them you aren't planning on coming back. That way you can be sure you get your disability.

I believe they can deny you and terminate you on your last day so that you wouldn't qualify for disability.

You would just need to go back to work for one day when your leave is over and resign.

Just apologize and say you intended to come back, so you don't burn any bridges.

(PS - I'm in HR. If anyone ever finds this post I'm probably fired!! Chat Icon)

This is half true.

NYS Disability is 6-8 weeks for vaginal or c-section at a max of $170 a week.

You are only offered your job stability during that time, unless you can qualify for FMLA.
Small Companies wont offer you FMLA

I think the first part you are right and second is FMLA, which is federal, not NYS. And if you work for a small company, you don't qualify.
