Legally I believe she has to clock out at least 30 mins a day for lunch. Check the department of labor..
This is how my job is...we have to clock out for 1/2 hour whether we work through it or not.

Re: UPDATE!!!!!!Need Advice
She needs to print a copy of that email and see a lawyer ASAP. Make sure she keeps her composure and makes him think he won for now. If not he may start looking for "legitate" reasons to get rid of her.

Re: UPDATE!!!!!!Need Advice
Sorry for the crash.
First she needs to print out the e-mail and make copies of it. Did she sign a contract at all? If so, what does the contract say? Contracts work both ways, so if there is not one signed then she actually has the upper hand. Not to mention that no matter what the contract says she is required by law to take a break.
IF God forbid ANYTHING happens to her or that baby, she will be able to sue the crap out of this boss of yours. You need to get her and that e-mail to a lawyer RIGHT away, before anything goes wrong with either the baby or your friend.

Re: UPDATE!!!!!!Need Advice
I'm by no means an expert, but I think her boss put himself in a really vulnerable situation by sending that email. As others have said, she is entitled to a break by law.
Do you have an HR department? -- if so I imagine they would have a heart-attack if they saw that email. It seems like he's making them vulnerable to a law-suit. I agree with the advice to seek help from an attorney.

Re: UPDATE!!!!!!Need Advice
gosh, that's just so crazy! I have no legal advice but I think you have that covered in the other responses.
However, as a manager, I can't even believe the lack of compassion of your boss, gender aside. Maybe I'm too much of a pushover, but in good conscience I could never tell anyone that they had to put their health, or their babies health in jeaopardy for a job. Sounds like it is a small company in which case as a manager if there was a real problem with her not being able to get her job done I probably would work out some sort of work from home deal until she finishes out her pregnancy. Hope it works out.

Re: UPDATE!!!!!!Need Advice
I would definitely tell your friend to SAVE that email and go to a lawyer NOW.
It completely sounds like discrimination to me. She has a medical reason for not being able to work the hours she does and employers have to make accomodations. She needs to save all emails and doctors notes and keep a log of all conversations she has with her boss.
Good luck and keep us updated!!

Re: UPDATE!!!!!!Need Advice
by law after working 6 hours you must take a minimum of a 1/2 hr lunch break. she must not ignore her drs recomendations and her own body signs. when i was preg. last yr i started getting weird pressure feelings and my dr told me to cut back at work, and as the manager of a crazy busy business there was no way to cut back(at least thats what i felt at the time) and one day at work at 5months and 3 weeks pregnant my water broke and i delivered a stillborn little girl. so she must do whats right for her and her baby!! when i am blessed with another pregnancy i will not be working at all, it used to be so important but once you suffer a loss it makes you prioritize. best of luck

Tell her definitely don't quit - she loses her benefits, disability, etc. She's better off getting fired.
Yes and no, under these circumstances she may be able to get Unemployment regardless. I QUIT the job I mentioned in the previous post (and it was a very small company excluded from a lot of things, but not in this case), there were enough illegal labor practices and "harassment" (not referring to sexual, but anything that is demeaning or makes an employee uncomfortable can consitute) that I took my chances. I got an attorney (FM me if you would like his info to pass on to your friend) and I won the case. Granted, she should check with the attorney prior to quitting to make sure, but since the boss is clearly breaking the law, I wouldn't think it would be a problem.
Even if fired it doesn't mean she'll get any other benefits beyond Unemployement. I'd take that email straight to a lawyer.

Re: UPDATE!!!!!!Need Advice
Here is the link to the EEOC's page on Pregnancy Discrimination.
http://www.eeoc.gov/types/pregnancy.html
I think she should start with filing a complaint with them, and then speak to an attorney.
for your friend!
