Real Estate Agent Question
Hi everyone,
I'm in need of some advice. My fiance and I saw a home with a real estate agent and we told them to put an offer in on the house. I did not sign anything but I believe they put it in. I then got a call that my offer was too low and I actually not sure if they actually put it in. I told them forget it. At that point I decided to call the listing agent. I proceeded to negotiate a deal with that agent. That deal was accepted and now my original agent and her agency is telling me I have to pay their commission. I did not go forward with the deal with the original person who showed me the house because they are sneaky and absolutely terrible. Apparently I now have to pay 10k more for the house because the seller (who also works for the listing agency) will not pay the commission to them. I am going to talk to my attorney tomorrow but I can't believe at this point I can't get this house because of this.
Anyone have any similar things happen or have any suggestions?

Ugh that is very unfortunate. However, once a realtor shows you a house you are binded to use them and it entitles them to commission. This almost happened to us but we ended up finding a home that fits our needs better.

It's amazing...they don't do their job, they keep asking me to pay more money for no reason, they don't keep me informed of anything... yet I have to pay more for the home just so they can get a commission which they do not deserve...
I have to have some legal right to fire them. I did not sign a Buyer disclosure form nor any actual offer sheets. As far as I'm concerned can I say I "never saw the home with them?"
It's 10k more that's a lot to just pay someone for not actually doing their job right.

Well, I am assuming you can "try" whatever you want. Although, it caused a big deal for us and I didn't find any loop hole out of it. You can argue that you were unaware of the policies and procedures and feel that you should have been informed about that practice. Good Luck!

Oh and I just re read your post, I dont think you can say that you never saw the home becuase they put an offer in on your behalf. I know that when I was negotiating, I did not have to put anything in writing and didn't sign anything for the actual offer.

Unbelievable! It's like, they can show the house to us then do absolutely nothing (I have no proof they actually put an offer in) and then still pocket the commission. It's exactly what was happening. Ridiculous! Now we need to fork over the more money in the sale if we want the house which we don't have. We're going to lose the house

I am siding with OP on this one. I can't believe you have to pay someone for never putting in the offer.
It happens so often that realtors "scare" you by telling you that you need to raise your offer.
I believe that realtor was faulty in her tactics and should feel the result of that.
Now, because nothing is signed, why is she entitled to any compensation?
Can't you find out from Sellers agent if your lady put the offer in or not?
Out of curiousity, what is the name or at least initials of the realtor that is causing this havoc?
I am scared it is mine. she pulls this kind of crap with possible buyers...

As fas as I know, an offer is supposed to be in writing, but many don't do that right away because of all the countering that goes on. I may be wrong here, but you may be able to use that to your advantage.

I tried; my attorney said I really have no leverage on any of this. Best thing I can do is have the agency waive the commission (which we know won't happen) or have the seller lower his price (which we know won't happen). So effectively, greed is what will prevent me from purching this home, all because someone spent 5 minutes walking around a house with me.
Just a note to all of you looking for a house - from what I've expreienced, it's just better to negotiate with the listing agent directly and not through another agent. They are more likely to push the seller to buy from you because they will get double the commission and also in doing so, there will never be a situation like I've encountered. Just my opinion.
