Real Estate Lawyer...
Can anyone recommend a Real Estate lawyer that I can call?
We are the previous posters with the $ pit house and I want to know what kind of recourse we have with our termite situation since she knew she had some kind of termites and supposedly had them "treated."
I spoke with our real estate attorney but I got a fishy feeling from him and he was originally referred to us by our realtor so I'm beginning to question his opinion on things...

I could be wrong here, but if the inspector doesn't see active termites then a termite inspection doesn't need to be done. If he saw current activity then you were suppose to get the inspection. If the termite inspector said it needs to be treated again than the seller would have needed to pay for treatment before you closed.
When we bought our house our inspector noticed old tunnels and the plugs in one of the room floors and it showed it was treated. She had treated years ago and they haven't come back as of yet. We are currently selling our house and a potential buyer had an inspection and said their was no activity that he could see.
Another thing that almost all seller's do is give the buyer's a $500 credit at closing. I believe the form that goes along with the credit basically says that the seller doesn't have knowledge of certain problems. If the seller chooses to not give the $500 credit then they fill out the form and it's line by line and then the seller is liable if they lie on the form.

We had a termite inspection come with our house inspection when we had a bid accepted on our house.
The house inspector saw termite damage to some wood planks in the basement and they had the termite inspector come in the next day - he said that there was no activity, but highly recommended that the planks/beams be replaced, and when we saw the wood beams they tore down, there was major and extensive damage. He said the owners had previously treated, but not recently, as the traps were not fresh, so he did a new treatment of the entire yard (front and back) and we're guaranteed for a year and we'll have them return next fall to repeat. The seller paid for all of this to be done as part of our contract.
