Sales Tax - Question about services - UPDATE - got my answer
Are "pure" services subject to sales tax? If so, all services or just some?
I may be confusing myself here... but, for example, I remember when I got married that there was no sales tax on the limos b/c it was purely a service. My photographer, however, did charge sales tax because it was both a service AND an end product (photos, album, etc., etc.)
Does anyone know exactly the distinction?
My cleaning service charges sales tax, but I'm honestly curious why they have to charge sales tax, whereas, for example, the limo companies don't.
Can anyone help me clear this up?
UPDATE -- found my answer, thanks to the link someone posted below. House cleaning is one of the specifically enumerated services subject to sales tax in NYS.

I am pretty sure that they should not charge you tax.
When we had a service in my old office I had to pay the bill and I am pretty sure there was no tax. We had an annual contract though, and I think I just paid a monthly disbursement....
ETA: Is this covered in the UCC?

As far as your cleaning lady , does she own her own business? or does she just do this as side work? Does she have a Tax ID number where she is filing taxes?

Assuming you live in NYS, this should help. (It's a PDF file)
Every state governs what is taxable and what is not and every state has different rules.
ETA: If you have any doubts, ask for their Sales Tax Registration Number. The state will issue one to any vendor who collects and pays sales tax.

Nope, we use a legitimate cleaning service that has a tax ID number, etc.
However, that shouldn't be the determing factor as to whether or not they can charge sales tax, should it?

I don't think the UCC governs this, but I am honestly not sure. Sales tax is a product of local law. It could be based on anything the state / county sees fit... so I guess it could be governed by the UCC, but I doubt it. Laws vary from state to state (and possibly even from county to county).
I'm going to read through the .pdf file that someone posted to see what I find!

Clearly, I'm very confused about this!
I'm not being cheap (the sales tax isn't that much). I just started thinking about it and got curious about the distinction...

I found my answer!
Cleaning real property (inside or out - so maid service, gardening, etc.) is a specifically enumerated service in NYS that is subjec to sales tax.

no. anyone can get a tax id number.
I just checked for you, in NYC there IS sales tax on cleaning and maintenance services. I am unsure about NYS though, but I might guess there isn't.
