School teachers question

I am just wondering, if you go on maternity leave and there is a break such as Christmas or February break in between...do you get a check for those weeks? the weeks of the vacation?

I started my maternity leave this week, but we have a strange contract with unlimited sick time. So I get paid from now until I return in September. But I had to leave because my doctor took me out.

I would normally only get the 6 weeks after the baby is born, which turns into summer vacation, so I would have gotten paid for the summer. But I would have lost those 6 weeks.

In my district you have to use your sick days. If you have enough sick ime and it covers a break then you get paid. As of right now I 'm not getting paid because I didn't have enough days to cover anything. I was still making up time when I went out on maternity from Nov'05-Feb'06 with my dd.

It's sick days concurrent with the 12 weeks (really 60 work days because of school schedules) of FMLA. Most teachers' sick days run out before FMLA is up. So the rest is w/o pay.

yes i know its without pay, but what if christmas break falls in there, do u get paid for that, everyone else does and they arent working!!

I am currently at full pay because I am using all of my sick days. They do not deduct sick days from my bank for the vacation days becuase in essence we do not work that time, it doesn't count towards the 180 school days.

To answer your question, I have received full pay, bi-monthly checks since the end of January when I was ordered out by my doc. That will continue until June. Vacations included.

Keep in mind, I was teaching for 11 years before going out on maternity leave so I had quite a large bank.

Some districts do limit the amount of days sick days you can cash in (in my cousin's district it's 60, which in essence is the 12 weeks FMLA). It can depend upon the contract. AS mine never wrote a limit in our contract, my asst. supt. had to honor my over 100 days. My situation is highly unusual as most owmen in my district have their children much earlier in their teaching career.

thanks so much for the information.....helped a lot, buit the thing is my ,leave will be paid for 4 weeks, i have 20 sick days...so after that it will be unpaid....so will i get paid for vacations in there...or am I on a leave and not entitled ot that....im waiting for a call back.....

are you on long island or nyc doe? i work for the city. i went out the day before february break, i got paid for it and then started my sick days. i even borrowed some sick days to keep me going a little longer on full pay. because i was still on the payroll with the sick days (whether mine or borrowed), i was able to get paid for the recent spring recess and those days were not from sick time!


if you work for the city, i can send you a very informative link from the union's website that is very helpful.

My DH said it depends upon what is in your contract...

He's a Union Rep for his District.

I'm a teacher in the city and I was wondering the same thing. I plan on borrowing 20 days but I will be out for much longer than that and missing christmas break. I doubt they will pay me for that week though. Chat Icon
