SWR - Important Name Change Questions
*Question: For what name changes will I need my *original* marriage certificate?
*If I change my name at the bank before changing it at work, will my direct deposit be messed up?
My situation: I have just changed my name at the DMV and at the social security office. I now have to change it with the bank, the utility companies, credit cards, etc.
Importantly, I am an attorney and need to change my name in the court in which I am admitted. I cannot practice under my new name until it has been processed. In order to do this, I must mail my original marriage certificate to the court and it will not be returned until the name change is processed. I want to make sure I get everything else done before I send it in.
Do I need it to change my name with the CC companies and utility companies -- or can I do that with a copy of the certificate?

I didn't need the marriage certificate at all to change any of my CC cards.
I needed a copy for utilities and for frequent flier/frequent guest cards (just a photocopy, not a certified one).
Other than the bank, SS and DMV, I only needed my original certificate for my passport.
ETA: I changed my name at work after I changed it at the bank (not that long after though, less than a week.
You should change it at work as soon as you change your SS number so your paychecks match the name on your SS card.

You should only need your original marriage certificate for the DMV and SS.
The direct deposit should be fine as long as the account number is still the same.
For my CCs I simply called them up and asked them to change my name, no need for the marriage certificate at all. One of my loans I had to send in a Xerox of the marriage certificate, but it didn't have to be an "original copy" with the raised seal.

i only needed my marriage cert for dmv, ss, my passport and i think the bank. i didnt need it for my cc's
as for changing your name w/ the courts, if you're uncomfortable sending in your original, you can get a certified copy from your town hall where you applied for the original. it will have a raised seal to show that it is authentic.

I only needed my original for social security. DMV i gave them a copy. I didn't need anything for my credit cards and I gave the gave the bank a copy.

I even did my car insurance over the phone -- and our premium went down $62 for a 6-month premium! COOL!

I used my new license and a copy of the marriage cert at the bank. The only other thing I know you need an original for is your passport, but you can always order a second certified copy form your town clerk (so I hear! )

Ours did too, they feel that married people are safer drivers.

It should be ok to wait as long as it's changed by the end of the year so the name on your tax return matches your W-2, if it is a problem to change it now.

make sure you tell your job right away that you changed the name on the bank account. my job told me my direct deposit wouldn't go through b/c of the name change. i had to coordinate my name change at the bank with my company's payroll cycle.

I was only admitted in NY at the time and they told me it would take about 2-3 months to update the "rolls" and that I should either hold off on my federal admission until then or expect that there might be some confusion when the federal court tried to confirm my state admission. Hope this helps
ETA: Just so you know, it is possible to get more than one "original" marriage license/certificate. You'll have to pay a small fee, but the town clerk can give you another "original" with the town seal on it.

Look into whether you can go to the courthouse in person to get this done. There are a lot of transactions that can be done that way and maybe you will not have to leave your marriage license. For 2nd Dept. I guess you would have to go to Brooklyn. I'm an attorney but I didn't change my name.

I did the same thing and had no problems. I agree that it takes a little while for your name change to be reflected with the New York state bar.

Thank you! I think I confirmed with HR that I can do this, too. I'm glad you were able to do it as well. I'm worried about the timing b/c I have to sign at least one filing in the next few weeks. I guess I can practice in court under my maiden name and use married for HR purposes at work until it's all straightened out.
How long before they sent you your stuff back?
I don't think I'll need the original again until I get my new passport and that can wait.

One more question for the helpful attorneys who responded... I don't appear in court much, but I do have a few pro bono cases that will have filings or something soon... Will the 2nd Dept make it really clear when I'm set for using my married name?
How do I handle cases in progress under my maiden name?

I got all my materials back in around 2 months, which is when I knew that they'd updated things. As for your upcoming filings, I'm not sure what the official rules are, but I'd leave them in your maiden name until you get the word from 2d Dept.
ETA: Luckily for me, I got married before I was "important" enough to have my name on anything If you're admitted to SDNY or EDNY, I wonder if you have to update your ID since it's supposed to be your first and last initial?

I'm only important enough to sign for pro bono cases. Another year at least before they even put my name on anything for the corporate clients!
It definitely stays in my maiden name - I remember reading that... Just wondering how I alert the judge when I am supposed to change it. Guess I'll wing it if it happens.
I've held off on my other court admissions for now b/c I was waiting to do the name change thing. God forbid I have to do this multiple times!

This is what I did. I changed my name at work, but I used my maiden name at depositions and on legal documents until I received something back from the court. I think my name change took about 1 month.
