Texas Senate Passes Bill Allowing OBs To Keep Info From Pregnant Women

The Texas Senate passed a controversial bill on Tuesday that critics argue would empower doctors to lie to pregnant women.
Senate Bill 25, which will now be sent to the Texas House, prevents parents from suing their doctor if their baby is born with disabilities, even if that doctor discovered the condition during routine prenatal testing and failed to inform the parents.
The architects of the so-called “wrongful-birth” bill have argued it would protect children with disabilities and prevent doctors from facing unnecessary facing lawsuits. “It is unacceptable that doctors can be penalized for embracing the sanctity of life,” Senator Brandon Creighton (R-TX) said in a press release when he introduced the legislation last fall.
But reproductive rights advocates have been relentless in their criticism of the measure, arguing that it would effectively make it lawful for a care provider who is opposed to abortion to avoid conducting prenatal testing, downplay test results or even lie to patients about test results if they believe those patients might consider terminating a pregnancy.
“SB 25 is another thinly veiled attempt to prevent Texans from accessing their constitutional right to abortion,” Heather Busby, executive director at NARAL Pro-Choice Texas, the reproductive healthcare advocacy group, said in an e-mailed statement to The Huffington Post. ...

Well that measure does nothing to trick the moms of non-disabled babies. They're going to have to find a way to circumvent women's rights and trick all pregnant women. I think Texas should just ban pregnancy tests altogether. Evil women can't get an abortion if they don't know they're pregnant, and by the time they figure it out it'll be too late. That'll teach them to think they have rights as women. They should go one further. Make sure Texan females are spared an education so they won't be able to read directions to the nearest abortion clinic.

My two cents - yes, the bill is an assault on women's rights, HOWEVER, every single court in the United States that has considered the issue of wrongful birth has always ruled against the parents. This was an area of discussion in constitutional law during my second year of law school.

Very curious about this. Are they cases where the doctor purposely withheld information from the parents? I just don't see why they need a law that may as well encourage doctors to keep parents in the dark.

Exactly...and the abortion discussion aside, many parents could benefit from knowing well in advance if their child is potentially handicapped. It could affect if they both go back to work, if they need a new car, specialists to meet prior to birth, etc. Being completely blindsided isn't doing anyone any favors.
