This makes me angry (LIRR related)
LIRR pays record amount in claims
Because people aren't being careful, they have to pay out all this money in claims. Who is it that really pays? Us. the commuters. I have to pay almost $300 a month because people are too stupid to look where they are going.
Am I over reacting or does anyone else feel the same way?

This is absolutely ridiculous - Watch where the hell you're walking - WHO doesn't realize that they have to take a step where the stationary track meets the moving train ???

Doesn't make me angry.
I know at least 10 guys who have ripped their workpants on the stupid low arm rests.
Changing trains in Syosset with snowboots on, I wiped out on the platform. I was sore for days. The stupid reason I slipped was not because the platforms weren't salted. It was because when you salt near the "Watch Your Step" signs which are painted, it melts & freezes easier making it a sheet of ice...and no I didn't put in a claim.

You know, I originally thought this myself, but then I was at the Oyster Bay station (I think it was OB at least) and you know what? That damn gap was BIG!
Now, of course I was able to navigate it but I could possibly see how someone who is old or not paying attention could get hurt.

it's actually not that ridiculous.
the gaps are too big and dangerous and somethings the platforms are slippery and the crowds are large.
and the armrest are low and rubbery and I catch things on them all the time.
LIRR sux and makes me angry for a lot of other different reasons which I will spare you from here

Those gaps are HUGE and irresponsible. There is a spot on track 18 at Penn Station that even I get nervous jumping (literally) over. And I'm watching out for it! It sux that the money is coming out of our, the commuter's, pocket, but I'd rather them take my money and make the station platforms safer.

ITA. When I was 6 MONTHS PREGNANT, a commuter knocked into me and my leg fell down the gap. I was terrified, but thankfully OK. With all the peopel rushing, its pretty scary. They should do what they can to make it safer- and some of these are in their control.

I don't think the gap claims are ridiculous, I think the payment amounts that these people are getting are gross. Frivolous lawsuits are aplenty.

We also have to factor in fraudulent claims. I've seen ad campaigns in Penn re: how faking injuries is criminal, but you've got to wonder how much of what's paid out is unmerited....

See, this to me, is legitimate claim. However someone falling into a gap because they are talking on their cell phone or drunk, or some other irresponsible reason, annoys me.

There ARE gaps that are huge (track 17, for example, at Penn) and at a few train stations. I believe there HAVE been legitimate claims.
HOWEVER, all the publicity about "watch the gap" I'm sure made a lot of people file frivolous claims hoping for a quick settlement.

That's why claims are assessed with a percentage of the fault on the passenger.
I do think of it as culling the herd as the idiots get caught in the gap the most but they do need to fix the gap issue.

I agree with the pants ripped from the pocket. DH told me about it. He has seen it so many times. He tries to be careful with them but it's a PITA.
Some gaps are REALLY bad. But I always watch my step when I step in and out of a train.

The problem is that 2 people may twist an ankle, but both will shake it off & one will try to cash in by claiming to be unable to work, etc. That's why they have investigators that follow people around to try to falsiify their claims. Many claims are undoubtedly real, but some are exaggerated or even wholly fabricated & people cash in at the riders' expense....

I'm not on the railroad much anymore but I have been shoved while exiting trains and subways. If I fall into the gap then, I expect to be compensated for medical expenses and pain and suffering.
Lawyers and law students-- I cannot think of cases against the LIRR without thinking of Palsgraf v. LIRR.

I just looked this up.
I can't imagine the days when they allowed fireworks on trains. I do remember the days where people used to jump on & off moving trains because I was knocked off a train to the platform by some idiot jumping off our train.
Glad they retired the old diesels.
