UPDATE on PAGE 1 Bottom: Need Help Body Shop and Laws

So I got into my accident on Feb 12.

We brought it to this shop that is owned by a guy we knew for about 2 years (he was the president of our bowling leauge).

Anyway fast forward to today. I still do not have my car back.

Everytime we talk to him its one excuse after another.

First a part was on back order for 2 mths, then he ordered the wrong part, then he was waiting for one more part and now the excuse is the rear A/C unit isnt working so he has to take it apart and re look at the wiring.

Where does it stop?

It's been almost 5 mths that I have been carless. We have stopped renting a car because it has costed us over $3000.

The problem is, when Geico gave us the check to fix the car, he told us he needed it to order parts. And what do we know? This was our first accident, and we thought we trusted him.

I am so fed up. Can anyone offer any advice or help???

Have you called your insurance company and ask them what you should do?

That is beyond ridiculous! If it was going to take that long to fix, they should just have totaled your car! Def call Gieco and complain...then i would call the BBB and complain about the shop!

I would get the car the a new body shop ASAP!

geico said there is nothing i can do because i gave the guy the check.

What did I know? I figured they sent it, give it to him especially if he asked for it considering we thought we could trust him.

If we bring it to another shop, how do we get our money back? Do we have to sue him?

I thought about contacting the BBB

I would just go and take the car back

take it to another shop to be re-evaluated - I can recommend a great one that my SUV is at now (since June 13th and I should be getting back in a week)

they also fixed my DH mustang- which requires custom parts and paint- it took them 5 weeks- they ordered the wrong hood and bumper- not their fault - the ford dealership didn't tell them our car was different


I would NOT call- I would just go there

I would get a flat bed and get the car to another shop ASAP.

I have a great one in Amyityville, fixed everyone in my family's car's.

Maybe the new shop can contact Geico and work something out as far as payment.

I don't know what you can do about getting your money back...you could demand they cut you a check for services not rendered, but I highly doubt they will.

If the insurance company already paid you and you signed the check over to the shop, they probably cannot help you. Unless the shop is a shop GEICO would send you to (some companies have shops they endorse and the shops in return agree to fix the vehicle for what the insurance pays, in a reasonable amount of time, etc) then GEICO has nothing more to do with it. They may try to call the shop on your behalf and try to speed things up, but that's about it.

I would complain to BBB and Dept. of Consumer Affairs. They might be able to get some of your money back for you. I'd also get my car out of there and to a reputable shop. It should not take that long to get parts for your car.

I don't understand why he told you he needed the check to order the parts. My dad owned an auto body shop for over 25 years and usually didnt get paid, whether it was from an insurance company or out of pocket until the customer was satisfied with the repair

yea i know. that is what everyone is telling me. i honestly didn't know. i figured he was telling me the procedure since i was never in an accident before. I didn't think he was going to screw me over like this.

My Dad owns a Body Shop and he does get the check most times before it is finished.

I can see how the AC is not working and they just found this out now. When he dropped off the car there was no need to test the AC. And now that the parts are in they probably test drove it and realized that the AC isn't working.

I can also see it taking awhile to get parts in and it being an honest mistake in ordering the wrong part and having to wait awhile to get in another one.

Also, do you have rental insurance? If not I highly rec getting it. It isn't that much more a month and it is well worth it.

I also don't see why you would call BBB? Have they asked for more money? Did they do a bad job? I would go there and talk to them personally before taking it a step further. JMO.

I think 5 months is more than a bit excessive regardless of the cause and certainly worthy of notifying the BBB. I agree with the others get a flatbed, take it to another shop and then sue this guy for your money back. It all sounds way too fishy.

Way too fishy about what? What do you think they are doing? Do you hoenstly think body shops want cars in their lots for a long time for no reason. Most yards aren't that big. And if you sue I can't see how you would win if he is doing everything right. If he askes for more money then I would thing something is going on.

So my DH just left the shop. My car has NOT been touched. It looks exactly like it did in Feb.

He told us this was done, and that was done.

He lied to us. Nothing has been touched!!!!!!!

All of the parts are sitting in boxes next to the car and that is the extent of it.

We called the lawyer to see what should be done.

See I try and give shops the benefit of the doubt because of my Dad being in the business and then jerks like this screw it up. They give all shops a bad name.Chat Icon Chat Icon

Dh is waiting a little longer at the shop for him to come back. we called another place that we should have went to in the first place. they are going to get it.

this guy is a real piece of work.

I am so sorry that this happened to you. My grandfather was also in the business and would not take payments until he knew the owners were satisfied. That was just his nature.

I would get a lawyer right away and then take him to small claims court to get back what was given to him originally and also sue for all your rental fees too.

Absolutely!! They could build the car from scratch in five months!! The guys a crook and probably blew her $$ on something else. Get your car out NOW!!
