W-2 Question
So my DH was working for one of our friends (I now use that term loosely)
He only worked for him for 4 months and now (thankfully) will be starting a great job
So in the beginning the guy gave him checks with pay stubs, but then started to hand write checks. They then were not being paid on time. So he still owes my DH four weeks of pay (from January) and has yet to send him a W-2. I want to do our taxes but am now afraid the guy never even paid the IRS I can figure out the taxes because I do have 3 pay stubs and I kept a record of every hand written check he received. The question is am I allowed to do this? I can't find anything on the IRS website about this. I did find a blank W-2 that I assume I can write in the info, but I don't have the tax-ID #. Also the last two checks he received were for work in December but he didn't get paid till January. Does that mean it would go on our 2009 return next year? My DH has gotten no answers from this guy(they had a big fight on my DH last day because of the money owed) We also found out that a current employee hasn't received his W-2 yet either.

Look for form 4852---its a replacement form for W-2s, 1099s, etc. if you can not obtain one...you can fill in the information that you have and submit it with your taxes. You shouldn't try and fill out your own W-2 form with the info--use the 4852 instead.
