The man had us without heat for the last few months forcing us to move out. We wanted to do the right thing and give him his 45 days notice. I gave him nov-dec rent and we were off in our new place. His apt is empty and now he is telling us that we need to turn on everything bc his pipes are going to freeze and we are going to be held responsible. I am preggo was forced out. the only reason I paid Nov-Dec was bc I want our 2200 security. Do I now have to turn back on keyspan/lipa?

the only thing is this...he still has 2200 until nov 30th and he said if his pipes crack between now and dec we are responsible. Truthfully with his roof leaking and no heat for the last 3 months, I think he will break his own pipes so we pay.

I would report him now..bring him to small claims. He is a slumlord.

You have more rights than he does.

I would tell him if he doesn't give you back your deposit you will report his azz. Also tell him you have spoken to a lawyer and that you do not have to turn the heat on it is his responsibility.

Unless you have documentation that he forced you out and failed to provide you with what landlords are supposed to provide, I think you should probably turn the heat back on.

Did you give him the keys? I would get them back if you did. Technically, you still have the apartment. Just leave the thermostat at 45 degrees and keep the place locked up.

I don't think he needs to worry about the pipes freezing before Nov. 30th. I don't think it's going to get that cold here before then. I grew up in MN and it would take a few days of sub-zero cold to make the pipes freeze in a stand-alone structure. And that's only if there was some water in the pipes.

ETA: Ah, no lease. That's a different story. I agree with the poster below...get your overpayment of rent back and your deposit back when your 30-day notice expires. And that's in a few days right? Don't bother turning the heat back on. What a jack***.

Heck no!!!! It's his problem if the pipes burst!! It would actually serve him right for keeping you without heat!!!! Why is he keeping your security till the 30th? Did you do a walkthrough and determine things were in the condition they were in when you moved in?

Ahh i see his issue... you moved out but the 45 days includes through Nov 30th. Your 45 days started Oct 15th. I think since you didnt have a lease you need to give 30 days notice NOT the 45 he wants. You could turn it all back on until the 15th.

If you did not have a lease, then you were on a month-to-month tenancy. In that case, he is only required to receive a 30-day notice as to when you will be leaving. He has received more rent than he is entitled to under the law and must return it. He, also, must return your deposit if there was no damage to the apartment (I hope you took pictures when you left) and cannot hold it in anticipation of something happening. You have vacated the apartment and he has access to it. He cannot hold you legally responsible since he is able to prevent any damage to his pipes and chooses not to. I would be sending him a certified letter stating such and telling him that I want return of the overpayment of rent and my security deposit in full within 30 days. If not, I will be taking him to court. He's trying to get more than he is entitled to and take advantage of a situation. He knows what he is doing and he needs to be set straight.
