 good question!
IMO, now that she has been caught 2x, she will DEFINITELY go to jail. Paris did her 30 or 45 days, and they didn't even catch her with drugs.

If Lindsay doesn't go to jail for this there is a BIG problem with our legal system.
Meanwhile.. when is Nicole Ritchie's court date? Maybe her and Lindsay can have a joint apperance to save some tax dollars...

Honestly, in reality, most people don't go to jail for DWI or possession. My DH is an ADA in narcotics and he tells me about some cases where defendents are holding serious drug weight and they still don't necessarily end up in jail.
Its the way the system works b/c the jails are overcrowded.

While I think both deserve to be in jail, there's so many people waiting in line ahead of them that sometimes the courts have to just let them back out on the street.

TMZ is reporting that her arraignment for this arrest is the same day as her court appearance for the first offense.

But don't you think a double offense (DUI & possession) and what with it being her 2nd arrest would land her ahead of the line or at least closer to the front? This is worse than the Paris incedent if you ask me...

well then maybe they need to start building more jails instead of walmarts!  letting criminals back on the street to hurt others makes so much sense

it doesn't work like that
and I believe this happened it 2 different counties? Phyl- you would know more then me
but she was just arrainged for the first case the other day - these things take alot of time before they get settled
however- most people are arrainged the next day or with in 3 to 5 days of being arrested- not 1 month later- but that gives her time to go to rehab again
and unfortunately in this country- you get what you pay for in terms of legal representation

Beverly Hills and Santa Monica are both in LA County.
