What is a survey???
I just got a call that my survey wasn't done, therefore, I can't have a clear to close for next week.
What is this, who is supposed to get it done, and who are they supposed to give it to???
Right now I want to scream, curse and hurt somebody.
I'm now unable to apply for the star program since it is due on March 1st.

The survey is an actual survey of the land. It gives the attorney the information on where your property lines are and stuff.
So if you are getting a 100x100 property... you get an actual 100x100 property... and not 98x98... stuff like that.
Blame your attorney for this one. He should have been on top of this and could have found out sooner that there was no survey available.

Isn't this all part of the title search? I thought that with the title came the survey? Or am I wrong?? Or is my attorney BSi'g me....
How long will this take??

My DH had gone to the town to get a copy of our survey, but they didn't have one so we had to get someone to do a survey. I don't remember how long that took - not long, just a matter of when they were available.

I don't think its related to the title search... but it is similar.
You have to first find out from the town if there is an existing survey they can use. If there is... its cheaper and you get it quicker.
If there isn't a survey available... you have to order a new one and its more expensive and takes more time.
But the attorney should have been on top of this.

If the Town has one, it would be in the Town Clerk's office. Go there, look up your property on the tax map, and get the section, block and lot #. Then the clerk's office should be able to get the file on your property, using that info, and you can see if there is an existing survey in their files. Often times, the survey was done when the house was built, or when a C.O. was filed.
If you have to get it done, you will probably have to hire a licensed surveyor to do it.

Time at the town, if they are staffed, probably less than an hour.
To do a survey: the survey itself probably could be done in a single morning or afternoon, I would guess a couple of hours. However, like other things, the wait time is probably more affected by the availability of the surveyor.

This IS a title company matter-I work for one. Our order form say: locate survey yes or no
If not located then order yes or no. So it may have been your attorney not following up or the title company dropping the ball. This can get done in a day if the title co. calls in a favor.

I agree.. Not only is it a requirement by the lender, but the title company cannot issue a title insurance policy to cover the total amount of the mortgage without the survey.
I also strongly recommend that you obtain a copy of the survey for your own records should you decide to add a patio or porch, you have it handy and know you are within your limits. Good luck.
