Union talks(question for people that know H.R.)

i have a job that's covered under the union. THe union are in talks since the contract expires at the end of Nov. In our shoptalk(e-mail from didn't members from the union) said someone from the company was at there bureau. If the contract gets signed after the deadline, she said there won't be any retroactivity. Is that legal? I thought if a contract is signed after the deadline, you're entitiled to your raise. We get our union raised every 12/1. HOpe this isn't confusing.

I am not positive, but I don't think they have to give you full retroactivity. I teach in NYC and if our contract passes we will not be getting full retro- there will be a six month gap between contracts that we won't get retro for. Hope this helps.

maybe it depends on the company. i know in the past they have. i just have to hope they'll change there mind

It may depend on what the union agrees to. I don't know if the company is required to pay retro pay or not, but I would imagine your union should be fighting for it as part of the new agreement. I am a fairly new employee, but as I understand it, we always get retro pay dated back to the date when the old contract expired. As I said before, though, this could be one of the conditions our union requires to sign the new contract.

Do you have a union rep you can ask about this? They should be able to answer those questions.

I just went through bargaining negotiations last year.

It depends on what was negotiated. Our contract we negotiated to include retroactive pay. However, if its not negotiated into the contract you are not entitled to it.

Both sides are expected to negotiate in good faith. If the Union holds out longer then after the contract expires for more pay and the administration finally agrees to it, they can state they will not pay retroactive pay since they may feel the hold out was due to the increased union demand.

retroactivity is never a guarantee, unless it's outlined in the CBA

To repeat what previous members said, retroactive pay is not mandatory. This is something that the union would need to negotiate.

I am a Labor Relations specialist, and we just had this situation, and we denied the unions request for retroactive pay. This was due to many reasons though...
