Lawyers for the man charged with murdering 7-year-old Nixzmary Brown have started a fund in the dead child's memory to help other families in distressed situations -- an idea supported by the accused killer.

Jeffrey T. Schwartz, who is representing Cesar Rodriguez, Nixzmary's stepfather, on second-degree murder charges, said Wednesday that he hopes to raise $5 million for the Nixzmary's Memorial CWIC Fund and funnel the money to families who are at risk for child abuse.

The letters "CWIC" stand for "Care When It Counts," the attorney said.

But news of plans for the fund brought a startled and outraged response from those representing Nixzmary's other relatives.

"We don't want him doing that!" said Wilma Cordiero, a spokeswoman for Nixzmary's relatives.

"I think it takes a tremendous amount of chutzpah to set up a fund after he killed the child," said Raul Meruelo, an attorney for Maria Gonzalez, Nixzmary's maternal grandmother. "I think without consulting the family, such behavior is, at the very least, in poor taste."

Schwartz admitted that some people might see the fund as a cynical gesture, but he denied that he was setting it up to refurbish Rodriguez's public image.

"I don't think anyone can enhance his image," said Schwartz, who added, without being specific, that his client had been vilified by leaks of false information from prosecutors and police. According to Schwartz, a number of celebrities have voiced support for the idea of a fund.

Rodriguez and Nixzaliz Santiago, his wife and Nixzmary's mother, were arraigned Wednesday in Brooklyn State Supreme Court on their murder indictments. Santiago appeared separately at her arraignment and answered with the word "innocent" through a Spanish language interpreter when a court clerk asked her how she pleaded to the indictment. About a half-hour later, Rodriguez appeared in court and entered a not-guilty plea through Schwartz.

Santiago's defense attorney, Robert Abrams, briefly spoke outside the courtroom and said he expected his client to be vindicated.

I dont know that i am mad about the fund. Yes, the guys a piece of cr@p. But me, I personally dont give a cr@p if he is trying to make himself look better or look innocent, everyone out there knows hes guilty as sin AND at least if we can see something positive...This dirt bags money is going to something productive for future situations. I think the guy in east northport should be punished by giving parts of his paycheck to animal foundations for the rest of his life. Just think if this was part of the law for criminals, there would be alot of money travelling the system.

I take back my statement, I didnt read "RAISE"...I thought it said he was gonna give this $$$ himself. Who in their right mind is going to give him $ for his fund. I wouldnt give this man a dime!
