ETA ---Just found out that you have to sue for over a million to get to Supreme Ct. in NY.

It does not state if it was or was not. It does say this:
"Alarm One officials ceased the practice in 2004, the year Orlando sued, after another employee complained of being injured, according to court records."
My guess? Is that is was not voluntary.

ETA ---Just found out that you have to sue for over a million to get to Supreme Ct. in NY.
That's not true. The New York Supreme Court is the trial court level at the state. To get into NY Supreme Court, you must allege more than $25,000 in damages. Cases with damages for less than that are in small claims court or city/district court.
ETA: This case looks like it's in CA. I don't know the requirements to get into state court there, but it wouldn't be anywhere near $1 million.

I agree. CA is the best place for an employee to sue - other than Canada
