Working Moms who work in NYS
Is it true that if your child is sick you are legally allowed to use your sick days for that? I know someone who is being given a very hard time by her employer for doing this, they are trying to document it and terminate her based on this.

I dont know the legality of it, but I am allowed to use my sick days for DS.
My job also has Family leave which allows me to take days to take care of a family member (parent, kid, spouse) without dipping into my days

I don't know about other places but yes, I'm allowed to use my sick time for a sick child. It's called Family Sick Leave (FSL) and is separate from FMLA (most times). I'm allowed to use up to 15 days a year for this purpose alone.
As a matter of fact, I haven't called in sick for MYSELF since before I gave birth. Every single sick day I've taken in the last 2 1/2 years has been because DS was sick, not me.
I also have the option to choose whether I use sick time or vacation time.

My sister works for the state - yes, it's true. I'm not sure what the ramifications are if you call in sick consistently... I'm sure there has to be some kind of guideline.

Right now my employer makes me use personal time...vacation time when DS is sick and I am in NY.

while in NYC you can call that 311 service- and ask them where to direct you to find out the correct information.

I work for NYC and technically, you are not allowed to do this. It's possible they are breaking the law, but I doubt it.

I save all my sick days for when DS is sick. I can even us a vacation day if I wish to.

If you work FOR NYS, yes.
If you just work IN NYS, no. It is not a law.
BUT, most companies these days have made it part of their policies that sick days are for the employee or a family member.

Ok, thanks. She works for a company in NYS (on LI) that doesn't have it spelled out in their employee manual. They were annoyed that she took her full FMLA leave so I think they are making things hard on her as payback.
I guess she'll have to try harder to find backup daycare, she has 2 kids so it must seem to her employer like one of them is sick all the time.

There is no law - it is employer discretion. In fact they don't even have to give you sick, vacation time period.

I work in NYS (not for) and we are allowed to use 1/2 of our sick days to care for sick family members including children, spouse or parent.

If my DC was sick then I wuld just call in and tell my job that I am sick so i can use it as a sick day. I am not to sure if they have a policy that says you can use sick days for DC. But I am sure my manager wouldnt care if i did either way.

They asked for a doctor's note since it's been a few days in a row, she she had to fess up. She has unlimited sick time but they are unhappy with how many she's taking at once.

I could see why they're busting her chops then. If they want to fire her, they're going to get their reason & do it.
If she wants to keep her job, I would suggest she talk about making up the time she is out for her child or discuss the possibility of working from home, if that's an option.
