Would you sue the daycare if your DC fell and needed stitches?

My friend's DS fell at a highly regarded daycare center. He got a HUGE cut and required stitches. Her child is fine now but my friend was obviously VERY upset. Her son is 13m old.

WWYD? Would you sue?

No. People are sue happy. Unless it intentionally happened, make sure the child gets the medical attention needed and leave it alone.
Accidents HAPPEN.

Kids fall....

Unless it was definately negligence on the teachers part, then no....

Her DC could have fallen at home and had the same outcome.

IMO her DS could have fallen at her own house. I think people are a little sue happy.

If they were being negligent and he fell out of a high chair that he wasn't buckled into, it is a different story. But if he was playing and fell on the play ground, to me that is normal toddler "wear and tear".

The thought wouldn't cross my mind unless there was so horrible mishap on their end that could affect other children/mine in the future.

No. Well, unless there was gross negligence or something. My son fell right in front of me and split his forehead open once, accidents happen.

Nope. And honestly, even if it was there fault because of negligence, I would probably just take my child out of their center and let that be the end of it. Unless it was something much worse than just needing stitches.

I doubt it, maybe if there was a history of obvious neglect. Kids that age fall and get hurt. DS got his first goose egg on his head a month ago, it totally broke my heart and I probably cried more than he did, but getting hurt happens even when you are standing right next to them.

Now if it was negligence and the injury was extensive, I would think about it.

Would depend on how it happened. If it was clearly negligance on their part - yes! If it was a freak accident, no.
God, I hope I never have to even think about that!

Sorry about your friend's DS!! I'm glad he's ok - but how awful for them!

Like others have said the only time suing them would cross my mind is if the caretakers were negligent. Kids fall, it happens. I'm home with DD and she has fallen more times then I can count. No stitches yet but lots of scrapes, bumps and bruises.

No, unless there was some major neglect involved, like they left him in a high chair or swing unstrapped. If he fell as a result of playing....no, these things happen. I would however expect their insurance (and it does) cover any medical expenses or deductibles, co-pays not covered by my insurance.



My DS fell and chipped half his front tooth at daycare....kids fall, its part of growing up. But in my care, he fell down a flight of stairs and broke his leg at the playground under my moms supervision when his was 1.5. Kids fall.

Like someone else said, even if it was negligent, I'd more likely pull DD out of there instead of suing...it would take something VERY major and malicious for me to even consider suing

Not for an accidental fall.

If I felt it was neglect or an abuse situation, I'd go way beyond suing. By neglect, I don't mean simple inattention from the teacher.

I feel like a fall could happen anywhere & is blameless.

I don't know all the details but I do think there was fault. One of the workers was let go. I'm assuming that person would not have been fired if there was no fault.

I feel like there is "karma" when people sue and things weren't that bad.....

Like you're pushing your luck...but that's just me...and a situation I was in once.

How would your friend feel if another baby was at your friend's house, and their baby fell, got stitches, and then sued her? It is an accident....if there was fault of one of the teachers, it may be very difficult to prove..are there cameras that record? How can you find out why the teacher was let go? Could it have been for soemthing else? If the baby is okay, I wouldn't want to push the issue...
