WWYD - Oil delivery from past homeowners oil company

so, as i was painting today, i heard a truck outside, and thought "sounds like an oil delivery i better ask DH to call his firiends' oil company for COD" (he had a delivery for 2.60ish per gallon). go to the front window and WE ARE GETTING AN OIL DELIVERY!

look at the receipt and i got a 3.4X per gallon delivery for 100 something gallons.

I WAS PIZZED. the receipt was to the old homeowners, i called the company they said, "they never cancelled, take it up with the old homeowners."

now, i do have their forwarding information, but, do i bother them with this?

my mother (who works for slomins) told me to tell them "cancel the account, i will not pay for this delivery, nor any in the future."

i don't want it to fall on the previous owners as we had a nice relationship with them.

WWYD???

I'd call the previous owners and ask them to call and cancel, and explain what happened.

Its not fair to ask them to pay for YOUR oil. while it stinks that you have to pay much more $$ then you could have, it was just something they probably never even thought to cancel. Chat Icon

i agree 100%, but think that i have to play hardball with the oil company. tell them the quote that we got from DHs friends oil company and tell them we will that that price for all the gallons that we received.

don't you think that's fair?

who is to say that they will find the previous owners anyway. besides, if i didn't pay it, i'd get a summons in the mail taking me to court, i'd bring the receipt that has the previous owners name on it, and they'd have to take legal action against the previous owners.

better my way, no?

I would def. try but I have a feeling they hear this alot. they *may* be able to put a lean on your home kinda like a contractor can if you don't pay them.

I would call and tell them you are willing to pay what you were quoted by another company or take me to court because your bill isn't even billing me. The sad part though may be when they summons the other people to court because you didn't pay. That would totally stink for them! so i would do whatever it takes to avoid that, and if in the end that means paying the bill without a discount, then so be it. sory you have to go through this!!Chat Icon

ITA! i would never do that to the sellers. they were kind, nice super wonderful people and that would be a stab in the back. apparently, there is something about me not being able to cancel their account? i suppose that makes sense. but... until monday when i call them back. it's only emergency service during the weekend. we'll see how this goes. i WISH i looked out the window sooner so that i could have stopped him.
oh-well. at least i have oil, right?

OMG I would literally laugh in their face if they told me that. Nice try.

You are the new homeowner on record. Their oil contract is with the previous homeowners, not yours. And the contract is most certainly not for the "house".

You know what I would tell them... "You took the previous homeowner's SSN for a reason. Use it".

Literally that is what I would say to them. And my god if they actually tried to sue you, i'd counter sue for my time.

Or if you want some cheap oil... tell them you will pay $1.99 a gallon for it. Thats below market price, and if I were them, i'd take it.

I got a letter from Petro saying I can get my first delivery for $1.99 if I signed up with them (previous homeowners had them). So I know oil companies will take the hit at that price.

No freakin' way are they going to put a lein on the OP's house.

The previous homeowners efffed up. It's their problem. The oil company legally will have to go after them.

Like I said, offer the oil company $1.99 a gallon. Tell them if they don't take it, they are more than welcome to start collections against the previous homeowners.

Most likely if they do that, the previous homeowners will be calling the OP asking for a "deal". Offer the same thing to the previous homeowners. $1.99 a gallon, and pay the previous homeowners directly since the oil bill is in their name... legally.

This happened to us when we moved in. I told them we weren't paying that $ and for them to come take the oil back.

They ended up taking the price I was quoted by the COD company.

WOW! i guess this is common. i never thought. DH said we will tell them to come and take the oil back. Curious what company it was that did this to you? FM me if you don't feel comfortable "saying it out loud."

I have Heat USA so I know how that works. You are not taking it up with them. Heat USA is just an intermediary. Even if you were to agree on a price for the oil, you wouldn't be paying Heat USA. You would be paying General.

Tell the oil company it's NOT your issue. The contract is not in your name, and it most definitely isn't in your house's name.

Man if that was me, i'd just keep the oil and never call them again. They can't touch you. At worst, they may want to come by and siphon out the oil, but I wouldn't even allow them to do that. They have no right to touch your heating equipment.

But that's just me as I am a PITA like that. Chat Icon

Do this:

Call General up... and pretty much give them two choices.

A) I am keeping the oil (I doubt they will agree to that - this choice is more for a laugh)

or

B) Since I have no contract, no obligation, and no obligation to even give you anything, i'll agree to pay $1.99/gal for the oil for your mistake. Send me an invoice for the amount of gallons you just delivered at $1.99 and i'll remit payment within the next 30 days.

or hell you can even tell them this to really get them worried

C) I already have an appointment to have gas installed next week. I don't need your stinkin' oil. Come siphon it out, and don't you dare take a drop more than what you put in because I am going to have it metered after you are done.


When they don't agree to any of this and insist they bill you at the market rate, just say no thanks and tell them to take you to court over it. They will never be able to show you signed anything for this. And in court you can say you offered a "deal" on the oil and you also offered for them to come take it. Than countersue for your time. I'd sue for a week's pay for you to take time off of work for your court date + additional dates to "prepare" for this suit brought upon you.

On an added note:

Why couldn't Petro (my previous homeowner's company) have done the same for me?

I just filled up 171 gallons on Saturday at $2.55/gal and could have used some free (or at least heavily discounted) oil. Chat Icon

This is why the oil company can get into SERIOUS trouble for unauthorized oil deliveries


What if you did a gas conversion the day you closed? Do you really think the oil company would still hold you liable if they delivered oil?

I thought of something else that you can get a good laugh with... call General up and tell them that they made an unauthorized oil delivery and if they don't remedy this situation within the next 72 hours, you are going to start charging them storage fees for their oil, as well as a trespassing charge for meddling around with your heating equipment.

They may laugh too, until they realize you are actually serious.

General S*CKS!

They are sneaky SOB's! Same thing happened to me when we moved in. We ended up keeping them for one year since the oil price decent. I called to them I didn't want to renew my contract and to NOT make a delivery! few days later,,,they made a delivery and I got a bill. I told them I cancelled, look at my account and come take back the oil they delivered because I am not paying a penny to what they claim I owe them. I am still dealing with this becaue I REFUSE to settle and pay the amount they claim I owe. Even the supervisor from the collection agency General reported me to is on my side! They are horrible!

The update is that HEAT USA said General wouldn't "make a deal" with us and therefore sending invoice to the original owner. they, too, asked for their forwarding information, which i refused them.

I know it's their fault that they didn't cancel the account, but i certainly don't want them to get slammed with this bill. I do feel bad about this. we'll work it out, i hope.

What is most likely going to happen is the old homeowners will probably contact you to make a deal.

There is nothing to feel bad about. They didn't cancel the contract. Also I don't see why General is in the wrong here. How are they supposed to know that the house was sold? They are entitled to deliver oil at the market rate with an open contract.

Let me also add that $3.4X per gallon is very expensive, especially with a HEATUSA discount. I was just quoted $2.89 a gallon (with Windsor Fuel) on Saturday. The price should be the same with General.

I said "3.4X" but really it was 3.04. that's a huge difference, my fault. sorry!
