HIPPA
Anyone familiar with HIPPA AND able to explain it to me in laymens terms?

It's a privacy law- Basically your medical records are confidential. Nobody but yourself (unless you state another person) can find out info on you unless they have a release from you. And medical staff can't share any info with anyone. It also goes as far as calling people by names in doctor waiting room-you are supposed to be called by a number. In a peds office-they aren't even supposed to hang xmas cards from patients bc it violates hippa.

Technically HIPAA has to do with the portability of your medical insurance to cover patients and make it easier to get new insurance if you have a pre-existing condition.
It also helps prevent health care fraud and abuse by creating standards which all health care officials, companies with access to health care information, etc. have to abide by to ensure privacy.
Because the privacy issues have been the "face" of the act and have been significantly pushed since 2003, it's often just referred to as a privacy act.

This is incorrect. I work in hospital administration. If you receive correspondence from the patient, and you have their permission you are allowed to post it.

HIPPA is a set of laws and the parts of it that people talk about are only the tip of the iceberg. HIPPA also means that you have an absolute right to your own medical records. Too many doctors try to hide behind HIPPA and not provide patients with their records. This is not what the law intended at all.

correct and you can take pictures to post in a ped office of any kind you just cant write the name in the front to identify who it is- name and date goes on back of picture.
our ped office has 2 picture boards and the kids have fun looking for themselves and to see if there is anyone they know- the parents love it too

This is true also. I had an endo that would not give me my records even when I sent certified letters.I had to get the state involved and within 2 weeks of the state getting involved I suddenly had my records.

That's what it first began as in 1996 (portability), but since then has evolved so much more and now the true significance lies in protecting patient's privacy and allowing them access to their medical records, etc...

You are allowed to call patients by name in a waiting room. Just as its not a HIPPA violation if someone else sees you in a waiting room and tells people you are there. The only exception would be if there is an option to be called by a number and you don't honor that, like in an anonymous HIV testing center for example. It is also not a violation to overhear another's information as long as there was a good faith effort to keep it quiet. Such as if you are sharing a hospital room with someone and the nurse/doctor closes the curtain between you two and you overhear the conversation anyway, that is not in violation because efforts were made to provide privacy. I have seen a lot of hospitals not put names on the outside of the doors and use initials instead. I believe I saw this in North Shore at Manhasset.
Enforcing HIPPA is not easy. I say, if you want to reap the benefits of HIPPA, you also have to comply with it even if you dont like it. Family members are not supposed to be inside the triage booth with the patient. The spouse always gets mad, but we are really not supposed to. I understand that your DH/FH whatever may say its OK to be there, but we have to enforce the rule for everyone. If the person does not speak english than we use them as a translator for the initial screening and then get someone else to translate later if there is anything the doctor feels needs to be asked privately. Of course if the patient is in distress than we get the history from the family member. There are situations where we like to interview patients (especially women) privately due to screening for domestic violence, and I feel an abusive husband will get suspicious if he is not allowed in but everyone elses family member is. Sometimes this is the only time the woman gets any time privately, because the husband may be there at the bedside when the doctor comes at all other times. I have also had men who have health conditions that thier wives/girlfriends don't know about, and they will not discuss it in front of them obviously.

In a nutshell..........People who know your medical hx, are treating you, and or are privy to your medical records can not discuss you medical hx with anybody that is not within your "circle of care". Example: You go to the ER and your nurse goes to luch., She can not talk about you to her friends unless that person is directly involved in your care, and then it would have to be in a non-prublic area. Does that help. It is verrrrrrrrrrrrrrrrry coomplicated and odd so I would have to know more about what you need to know. FM and i'll try to help.
