? about moving out of state

just incase any of u ladies would know the answer to this...

my friend is not married to her child's father - things are bad between them and she wants to move. can she move with the child (2 months old) without the father's consent? they don't have any paperwork filed an she isn't sure of her rights.

No, if he is listed as the father, then they must go throught the corts and he can contest. Sorry. I wish your friend the best of luckChat Icon

yes, this is true, however, the father can give permission to the BM to move out of state...this is what DH did when BM wanted to move to NJ...they did not have to go to court b/c he allowed the move. But is sounds as if in this case they may not have such a mutual agreement.

thank you ladies...her family is up here and she's down in fl w/his family. he doesn't want to get married,doesn't want to work on things, but he doesn't want her to go back to her family - so she's not sure what to do. i told her to contact a lawyer...sad situation :(

She has to comply with Florida laws which can be very different from NY laws. She has to file a petition asking to relocate and be awarded full residential custody.
