Is this true???? Regards to teaching license and hiring freeze

Long story short...my dh has a phys ed license. He originally taught in hs for 5 years and got tenure there. He then went to a middle school and is about to get his tenure this year for middle school. There is an opening in a h.s and he wants to move back. One of the union reps said that he believes b/c of the hiring freeze he has to now stay in the middle school, but said he wasn't absolutely sure he'd check and get back to him. I thought the hiring freeze pertains to new hires not current doe employees? Anyone know?

Why does he need to get tenure for the middle school? Tenure is citywide not based on a specific school

Did he switch to elementary phys ed?

The hiring freeze is for new hires but I think schools have to take ATRs before transfers. Not sure about this though.....

That's what I was like I didn't even know that he had to get a new tenure when going to middle school, it's not as if he switched the subject he taught, just that he went from H.S to middle school. He ended up getting excessed b/c he is just getting his tenure in middle school although his total overall years are more than two other people in the middle school. Again I was like, huh.... you have more years overall and have been in the building longer then the other teachers....it has got to count for something. Just found out that both the other teachers with less years are very good friends with the principal...ahhh politics at it's finest.

So now since he's going into ATR, I told him if there is a job in the H.S. he should be able to go back...the whole point is to get out of ATR. I think that the union rep really wasn't sure, and that is why he said he'd get back to him. Thanks!

But for phys ed isn't the license from K-12? Or am I wrong? Even if it's 7-12 that covers middle and high school.

It's not like he has two licenses like for example elem ed and special ed and was tenured in elem ed and now wants to teach special ed....there I could see a problem because it would be a different tenure track.

ETA--Did he call the UFT office? Sometimes union reps don't know what the hell they are talking about.

he cannot be excessed because of politics. it has to be by license area seniority. example- my building excessed 7 gen ed teachers, but is hiring 2 special ed teachers. he should call the union offices.

People within the system must be given jobs first. There is a hiring freeze unless it's a new school, which can take new teachers. However, the high school does not have to take him unless they want him- there are no transfers based on seniority anymore. Is he being excessed from his current school? If not, I would keep it quiet about the hs job until he definitely has it because the high school does not have to take him.

Tenure is based on the license you are using. So I have four licenses. I have B-2 Sped Ed and 2-6 Spec Ed,... if I taught K sped. ed but wanted to switch to 5 sped. ed, it would be the same tenure-- so I dont know what the UFT rep is talking about..

Thanks so much everyone. I thought it didn't sound right. I'm going to have my dh call again on Monday. The UFT definitly doesn't make it easy to find things out.
