anyone ever get unemployment after being fired?
I am on shaky ground at work due to being out sick. Its a vlid reason, but my dr's are idiots and Im not sure they are doing what they should eb to get me short term disability.
Anyway- I read the NYS unemployment info online just in case, and it does not say anything about not qualifying if fired..only if it was gross misconduct or a crime committed.
Anyone get this after being fired( not laid off) ???

I'm pretty sure that unless you're laid off the only way you can get it from being fired is if your company oks it.
I'd be very shocked if you get fired over sickness, that sounds like a lawsuit waiting to happen....

thats not what the website says as far as rules go though.
It says if you voluntarily quit without GOOD reason you cannot, or if you get fired for gross misconduct.

it says
Voluntary Quit and Misconduct You will be disqualified from receiving unemployment insurance if:
You quit a job without good cause; or
You quit a job due to marriage; or
You lost a job because of misconduct; and
You have not subsequently worked and earned five times your benefit rate.

You absolutely can get unemployment if you are fired.
The only way I believe that you can't receive unemployment after being fired is if you are fired for a reason such as a stealing or fighting or things like that.

Yes you can get unemployment if you are fired that is why some companies try to force you to quit instead.. but sickness IS a def lawsuit if that is why you being fired

DH collected when his wages were cut in half and he quit. That was in FL though, and his company fought him on it, but he won

Im in HR you can definitly get unemployment if fired as long as it wasn't due to as you said, gross misconduct and crime committed.

You can get unemp if you did not get termed for misconduct. The NYS det of unemp will call the HR office to verify the reason and ask the HR Manager if they want to ok or deny the claim.
If you are sick, you should NOT be fired due to illness. What is the company's disability policy? I know that if you are out for more than 5 consecutive days that's when STD kicks in (usually). If it's random sporadic days then your HR people should sit down with you to discuss the options.

I was out for 10 consecutive days, Short term diability not yet approved or denied, I have a feeling it may be denied as the dr was a DOPE, wouldnt sign the papers, only send office notes over, and it may not be enough.
Then was out 1 and 1/2 days a week later
and this week today and half yesterday...ALL related , the HR dept. said get a note SEALED in an envelope fromt he dr's saying it was all related...well easier said then done..The Dr's do not call me back, do not for some unbeknownst reason want to do this. NO lying is involved, All I need for them to say is I was there...BUT they want me to go back to the 1st dr, who is a DOPE( did I mention this) and too lazy to do all this , so I feel like Im STUCK in the middle, and that the lack of "evidence" thanks to idiot Dr's is gonna get me fired.
